Article 219: a. In general

Part Two: Special Obligational Relationships › Chapter One: Contract of Sale › Division Two: Sale of Movable Property

The seller shall be liable not only for the absence in the object sold of qualities that the seller has represented to the buyer in any manner whatsoever, but also for the existence of material, legal or economic defects that are contrary to the quality or to the quantity affecting the quality, and that eliminate or considerably reduce the value of the object sold with regard to its intended use or the benefits the buyer expects from it.

The seller shall be liable for such defects even if the seller did not know of their existence.

MADDE 219 · a. Genel olarak

Satıcı, alıcıya karşı herhangi bir surette bildirdiği niteliklerin satılanda bulunmaması sebebiyle sorumlu olduğu gibi, nitelik veya niteliği etkileyen niceliğine aykırı olan, kullanım amacı bakımından değerini ve alıcının ondan beklediği faydaları ortadan kaldıran veya önemli ölçüde azaltan maddi, hukuki ya da ekonomik ayıpların bulunmasından da sorumlu olur.

Satıcı, bu ayıpların varlığını bilmese bile onlardan sorumludur.
