Article 211: 2. Costs of delivery and transport

Part Two: Special Obligational Relationships › Chapter One: Contract of Sale › Division Two: Sale of Movable Property

Unless otherwise agreed or customary, the costs of delivery, such as measuring and weighing, shall be borne by the seller, while the costs incurred in taking delivery of the object sold and, where the object sold must be transported to a place other than the place of performance, the transport costs shall be borne by the buyer.

Where delivery free of costs has been agreed, the seller shall be deemed to have assumed the transport costs.

Where delivery free of port and customs charges has been agreed, the seller shall be deemed to have assumed the export, transit and import duties; however, the seller shall not be deemed to have assumed the consumption taxes paid at the time the object sold is taken over by the buyer.

MADDE 211 · 2. Devir ve taşıma giderleri

Aksine sözleşme veya âdet yoksa, ölçme ve tartma gibi devir giderleri satıcıya, satılanı devralmak üzere yapılan giderler ve satılanın ifa yerinden başka yere taşınması gerektiğinde, taşıma giderleri alıcıya aittir.

Gidersiz devir kararlaştırılmışsa, satıcı taşıma giderlerini üstlenmiş sayılır.

Liman ve gümrük giderleri olmaksızın devir kararlaştırılmışsa satıcı, dış satım, transit ve dış alım vergilerini üstlenmiş sayılır; ancak satılanın alıcı tarafından devralındığı sırada ödenmiş olan tüketim vergilerini üstlenmiş sayılmaz.
