Article 234: III. Maturity of the sale price and interest

Part Two: Special Obligational Relationships › Chapter One: Contract of Sale › Division Two: Sale of Movable Property

Unless otherwise agreed, the sale price shall become due once the object sold comes into the possession of the buyer.

Where there is a usage that interest may be claimed, or where the buyer is able to obtain fruits or other yields from the goods, or where default occurs upon the expiry of a specified day, interest on the sale price may be claimed without the need for a separate warning.

MADDE 234 · III. Satış bedelinin muacceliyeti ve faizi

Aksine sözleşme yoksa, satılan alıcının zilyetliğine girince satış bedeli muaccel olur.

Faiz istenebileceği konusunda bir teamül varsa veya alıcı maldan ürün ya da diğer verimler elde etme imkânına sahip ise ya da belirli günün geçmesiyle temerrüdün gerçekleşmesi durumunda, ayrıca bir ihtara gerek olmaksızın satış bedeline faiz istenebilir.
