Article 236: 2. Calculation and compensation of damage

Part Two: Special Obligational Relationships › Chapter One: Contract of Sale › Division Two: Sale of Movable Property

A buyer who fails to perform its obligation shall be liable to compensate the damage suffered by the seller as a result.

The seller may claim from a buyer who has fallen into default in paying the sale price compensation for the damage calculated on the basis of the difference between that price and the price obtained by selling the object sold to another person in good faith.

If the object sold consists of goods listed on an exchange or having a market price, the seller may, without the need for such a sale, claim from the buyer compensation for the damage calculated on the basis of the difference between the sale price and the price of the goods on the day fixed for payment.

MADDE 236 · 2. Zararın hesaplanması ve giderimi

Borcunu ifa etmeyen alıcı, satıcının bu yüzden uğradığı zararı gidermekle yükümlüdür.

Satıcı, satış bedelini ödemede temerrüde düşmüş olan alıcıdan, bu bedel ile satılanın başkasına dürüstlük kurallarına uygun olarak satışından elde ettiği bedel arasındaki farka göre hesaplanacak zararın giderilmesini isteyebilir.

Satılan, borsada kayıtlı veya piyasa fiyatı bulunan mallardan ise satıcı, böyle bir satışa gerek kalmaksızın alıcıdan, satış bedeli ile malın belirlenmiş ödeme günündeki fiyatı arasındaki farka göre hesaplanacak zararın giderilmesini isteyebilir.
