Article 500: III. Termination for personal reasons

Part Two: Special Obligational Relationships › Chapter Eight: Publishing Contract

If the author dies or loses the capacity to complete the work before completing it, or if completing the work becomes impossible without his fault, the contract shall terminate automatically. However, if performance of the contract in whole or in part is found to be possible and equitable, the judge may decide that the contractual relationship shall continue and that the changes required for this purpose shall be made.

If the publisher becomes bankrupt, the grantor may give the work to another publisher; however, if security has been provided for the performance of the obligation not yet due at the time of bankruptcy, the grantor may not give the work to another publisher.

MADDE 500 · III. Kişisel sebeplerle sona ermesi

Eser sahibi eseri tamamlamadan önce ölür veya tamamlama yeteneğini yitirir ya da eseri tamamlaması kendi kusuru olmaksızın imkânsız duruma gelirse, sözleşme kendiliğinden sona erer. Ancak, sözleşmenin tamamı veya bir bölümünün yerine getirilmesi mümkün ve hakkaniyete uygun bulunursa hâkim, sözleşme ilişkisinin devam etmesine ve bunun için gereken değişikliklerin yapılmasına karar verebilir.

Yayımcı iflas ederse yayımlatan, eseri başka bir yayımcıya verebilir; ancak, iflas anında henüz muaccel olmamış borcun yerine getirileceği konusunda güvence gösterilmişse, yayımlatan eseri başka bir yayımcıya veremez.
