Article 520: A. Definition and form

Part Two: Special Obligational Relationships › Chapter Nine: Mandate Relationships › Division Three: Brokerage Contract

A brokerage contract is a contract whereby the broker undertakes to prepare the opportunity for the conclusion of a contract between parties or to act as intermediary in its conclusion, and becomes entitled to remuneration if that contract is concluded.

As a rule, the provisions on mandate shall apply to the brokerage contract.

A brokerage contract relating to immovable property shall not be valid unless made in writing.

MADDE 520 · A. Tanımı ve şekli

Simsarlık sözleşmesi, simsarın taraflar arasında bir sözleşme kurulması imkânının hazırlanmasını veya kurulmasına aracılık etmeyi üstlendiği ve bu sözleşmenin kurulması hâlinde ücrete hak kazandığı sözleşmedir.

Simsarlık sözleşmesine, kural olarak vekâlete ilişkin hükümler uygulanır.

Taşınmazlar konusundaki simsarlık sözleşmesi, yazılı şekilde yapılmadıkça geçerli olmaz.
