Article 2: Principle of legality of offences and penalties

Part One: Fundamental Principles, Definitions and Scope of Application › Chapter One: Fundamental Principles and Definitions

(1) No one shall be punished, and no security measure shall be imposed, for an act which the law does not expressly define as an offence. No penalty or security measure other than the penalties and security measures prescribed by law shall be imposed.

(2) Offences and penalties shall not be established by regulatory acts of the administration.

(3) Analogy shall not be applied in the implementation of provisions of laws that define offences and penalties. Provisions that define offences and penalties shall not be interpreted broadly in a manner leading to analogy.

MADDE 2 · Suçta ve cezada kanunîlik ilkesi

(1) Kanunun açıkça suç saymadığı bir fiil için kimseye ceza verilemez ve güvenlik tedbiri uygulanamaz. Kanunda yazılı cezalardan ve güvenlik tedbirlerinden başka bir ceza ve güvenlik tedbirine hükmolunamaz.

(2) İdarenin düzenleyici işlemleriyle suç ve ceza konulamaz.

(3) Kanunların suç ve ceza içeren hükümlerinin uygulanmasında kıyas yapılamaz. Suç ve ceza içeren hükümler, kıyasa yol açacak biçimde geniş yorumlanamaz.
