Article 210: Documents deemed official documents

Book Two: Special Provisions › Part Three: Offences Against Society › Chapter Four: Offences against Public Trust

(1) Where the subject of the offence of forgery of a private document is a bill of exchange payable to order or to bearer, a document representing goods, a share certificate, a debenture or a will, the provisions on the offence of forgery of an official document shall apply.

(2) A physician, dentist, pharmacist, midwife, nurse or other member of the health professions who issues a document contrary to the truth shall be punished with imprisonment from three months to one year. Where the document issued provides an unjust benefit to a person or is of a nature producing a result to the detriment of the public or of individuals, a penalty shall be imposed in accordance with the provisions on forgery of official documents.

MADDE 210 · Resmi belge hükmünde belgeler

(1) Özel belgede sahtecilik suçunun konusunun, emre veya hamile yazılı kambiyo senedi, emtiayı temsil eden belge, hisse senedi, tahvil veya vasiyetname olması halinde, resmi belgede sahtecilik suçuna ilişkin hükümler uygulanır.

(2) Gerçeğe aykırı belge düzenleyen tabip, diş tabibi, eczacı, ebe, hemşire veya diğer sağlık mesleği mensubu, üç aydan bir yıla kadar hapis cezası ile cezalandırılır. Düzenlenen belgenin kişiye haksız bir menfaat sağlaması ya da kamunun veya kişilerin zararına bir sonuç doğurucu nitelik taşıması halinde, resmi belgede sahtecilik hükümlerine göre cezaya hükmolunur.
