Article 99: Causing miscarriage

Book Two: Special Provisions › Part Two: Offences Against Persons › Chapter Five: Causing Miscarriage, Self-Induced Miscarriage or Sterilisation

(1) Any person who causes a woman to miscarry her child without her consent shall be punished with imprisonment from five to ten years.

(2) Any person who, in the absence of medical necessity, causes a woman whose pregnancy has lasted more than ten weeks to miscarry her child, even with her consent, shall be punished with imprisonment from two to four years. In this case, the woman who consents to the miscarriage of her child shall be sentenced to imprisonment of up to one year or a judicial fine.

(3) Where the act set out in paragraph 1 has caused harm to the physical or mental health of the woman, the person shall be punished with imprisonment from six to twelve years; where the act causes the death of the woman, imprisonment from fifteen to twenty years shall be imposed.

(4) Where the act set out in paragraph 2 has caused harm to the physical or mental health of the woman, the person shall be punished with imprisonment from three to six years; where the act causes the death of the woman, imprisonment from four to eight years shall be imposed.

(5) Where the child of a woman whose pregnancy has not completed ten weeks is caused to be miscarried by an unauthorised person, even with her consent, imprisonment from two to four years shall be imposed. Where the other acts defined in the preceding paragraphs are committed by an unauthorised person, the penalty to be imposed under those paragraphs shall be increased by one half.

(6) Where a woman becomes pregnant as a result of an offence of which she is the victim, no penalty shall be imposed on the person who terminates the pregnancy, provided that the pregnancy has not lasted more than twenty weeks and that the woman consents. However, for this purpose, the pregnancy must be terminated by specialist physicians in a hospital setting.

MADDE 99 · Çocuk düşürtme

(1) Rızası olmaksızın bir kadının çocuğunu düşürten kişi, beş yıldan on yıla kadar hapis cezası ile cezalandırılır.

(2) Tıbbi zorunluluk bulunmadığı halde, rızaya dayalı olsa bile, gebelik süresi on haftadan fazla olan bir kadının çocuğunu düşürten kişi, iki yıldan dört yıla kadar hapis cezası ile cezalandırılır. Bu durumda, çocuğunun düşürtülmesine rıza gösteren kadın hakkında bir yıla kadar hapis veya adlî para cezasına hükmolunur.

(3) Birinci fıkrada yazılı fiil kadının beden veya ruh sağlığı bakımından bir zarara uğramasına neden olmuşsa, kişi altı yıldan oniki yıla kadar hapis cezası ile cezalandırılır; fiilin kadının ölümüne neden olması halinde, onbeş yıldan yirmi yıla kadar hapis cezasına hükmolunur.

(4) İkinci fıkrada yazılı fiil kadının beden veya ruh sağlığı bakımından bir zarara uğramasına neden olmuşsa, kişi üç yıldan altı yıla kadar hapis cezası ile cezalandırılır; fiilin kadının ölümüne neden olması halinde, dört yıldan sekiz yıla kadar hapis cezasına hükmolunur.

(5) Rızaya dayalı olsa bile, gebelik süresi on haftayı doldurmamış olan bir kadının çocuğunun yetkili olmayan bir kişi tarafından düşürtülmesi halinde; iki yıldan dört yıla kadar hapis cezasına hükmolunur. Yukarıdaki fıkralarda tanımlanan diğer fiiller yetkili olmayan bir kişi tarafından işlendiği takdirde, bu fıkralara göre verilecek ceza, yarı oranında artırılarak hükmolunur.

(6) Kadının mağduru olduğu bir suç sonucu gebe kalması halinde, süresi yirmi haftadan fazla olmamak ve kadının rızası olmak koşuluyla, gebeliği sona erdirene ceza verilmez. Ancak, bunun için gebeliğin uzman hekimler tarafından hastane ortamında sona erdirilmesi gerekir.
