Article 107: Blackmail

Book Two: Special Provisions › Part Two: Offences Against Persons › Chapter Seven: Offences against Liberty

(1) Any person who, by stating that he or she will do or will not do something that he or she has a right or an obligation to do, forces another person to do or not to do something that is unlawful or that such person is not obliged to do, or to provide an unjust benefit, shall be punished with imprisonment from one to three years and a judicial fine of up to five thousand days.

(2) Added: 29/6/2005, Law No. 5377, Art. 14 Where a threat is made, for the purpose of obtaining a benefit for oneself or another, to disclose or impute matters of a nature that would harm a person's honour or reputation, the penalty under paragraph 1 shall likewise be imposed.

MADDE 107 · Şantaj

(1) Hakkı olan veya yükümlü olduğu bir şeyi yapacağından veya yapmayacağından bahisle, bir kimseyi kanuna aykırı veya yükümlü olmadığı bir şeyi yapmaya veya yapmamaya ya da haksız çıkar sağlamaya zorlayan kişi, bir yıldan üç yıla kadar hapis ve beşbin güne kadar adlî para cezası ile cezalandırılır.

(2) (Ek: 29/6/2005 – 5377/14 md.) Kendisine veya başkasına yarar sağlamak maksadıyla bir kişinin şeref veya saygınlığına zarar verecek nitelikteki hususların açıklanacağı veya isnat edileceği tehdidinde bulunulması halinde de birinci fıkraya göre cezaya hükmolunur.
