Article 114: Obstruction of the exercise of political rights

Book Two: Special Provisions › Part Two: Offences Against Persons › Chapter Seven: Offences against Liberty

(1) Any person who uses force or threat against another person for the purpose of compelling him or her:

a) To become or not to become a member of a political party, to participate or not to participate in the activities of a political party, or to leave a political party or his or her office in the management of a political party,

b) Not to stand as a candidate for a public office attained through election, or to leave the office to which he or she has been elected,

shall be punished with imprisonment from one to three years.

(2) Where the activities of a political party are obstructed by using force or threat or by any other unlawful conduct, imprisonment from two to five years shall be imposed.

MADDE 114 · Siyasi hakların kullanılmasının engellenmesi

(1) Bir kimseye karşı;

a) Bir siyasi partiye üye olmaya veya olmamaya, siyasi partinin faaliyetlerine katılmaya veya katılmamaya, siyasi partiden veya siyasi parti yönetimindeki görevinden ayrılmaya,

b) Seçim yoluyla gelinen bir kamu görevine aday olmamaya veya seçildiği görevden ayrılmaya,

Zorlamak amacıyla, cebir veya tehdit kullanan kişi, bir yıldan üç yıla kadar hapis cezası ile cezalandırılır.

(2) Cebir veya tehdit kullanılarak ya da hukuka aykırı başka bir davranışla bir siyasi partinin faaliyetlerinin engellenmesi halinde, iki yıldan beş yıla kadar hapis cezasına hükmolunur.
