Article 118: Obstruction of the exercise of trade union rights

Book Two: Special Provisions › Part Two: Offences Against Persons › Chapter Seven: Offences against Liberty

(1) Any person who uses force or threat against another person for the purpose of compelling him or her to become or not to become a member of a trade union, to participate or not to participate in the activities of a trade union, or to leave a trade union or his or her office in the management of a trade union shall be punished with imprisonment from six months to two years.

(2) Where the activities of a trade union are obstructed by using force or threat or by any other unlawful conduct, imprisonment from one to three years shall be imposed.

MADDE 118 · Sendikal hakların kullanılmasının engellenmesi

(1) Bir kimseye karşı bir sendikaya üye olmaya veya olmamaya, sendikanın faaliyetlerine katılmaya veya katılmamaya, sendikadan veya sendika yönetimindeki görevinden ayrılmaya zorlamak amacıyla, cebir veya tehdit kullanan kişi, altı aydan iki yıla kadar hapis cezası ile cezalandırılır.

(2) Cebir veya tehdit kullanılarak ya da hukuka aykırı başka bir davranışla bir sendikanın faaliyetlerinin engellenmesi halinde, bir yıldan üç yıla kadar hapis cezasına hükmolunur.
