Article 127: Proof of the imputation

Book Two: Special Provisions › Part Two: Offences Against Persons › Chapter Eight: Offences against Honour

(1) Where the imputed act constituting an offence has been proven, no penalty shall be imposed on the person. Where a final judgment of conviction has been rendered against the insulted person on account of that offence, the imputation shall be deemed proven. In other cases, the acceptance of a request to prove the imputation shall depend solely on there being a public interest in establishing whether or not the imputed act is true, or on the consent of the complainant to such proof.

(2) Where a person is insulted by reference to an act of theirs that has been proven, a penalty shall be imposed.

MADDE 127 · İsnadın ispatı

(1) İsnat edilen ve suç oluşturan fiilin ispat edilmiş olması halinde kişiye ceza verilmez. Bu suç nedeniyle hakaret edilen hakkında kesinleşmiş bir mahkûmiyet kararı verilmesi halinde, isnat ispatlanmış sayılır. Bunun dışındaki hallerde isnadın ispat isteminin kabulü, ancak isnat olunan fiilin doğru olup olmadığının anlaşılmasında kamu yararı bulunmasına veya şikayetçinin ispata razı olmasına bağlıdır.

(2) İspat edilmiş fiilinden söz edilerek kişiye hakaret edilmesi halinde, cezaya hükmedilir.
