Article 136: Unlawfully giving or seizing data

Book Two: Special Provisions › Part Two: Offences Against Persons › Chapter Nine: Offences against Private Life and the Confidential Sphere of Life

(1) Any person who unlawfully gives personal data to another person, disseminates them or seizes them shall be punished with imprisonment from two to four years.

(2) Added: 17/10/2019, Law No. 7188, Art. 17 Where the subject of the offence consists of statements and images recorded pursuant to paragraphs 5 and 6 of Article 236 of the Code of Criminal Procedure, the penalty to be imposed shall be increased by one fold.

MADDE 136 · Verileri hukuka aykırı olarak verme veya ele geçirme

(1) Kişisel verileri, hukuka aykırı olarak bir başkasına veren, yayan veya ele geçiren kişi, iki yıldan dört yıla kadar hapis cezası ile cezalandırılır.

(2) (Ek:17/10/2019-7188/17 md.) Suçun konusunun, Ceza Muhakemesi Kanununun 236 ncı maddesinin beşinci ve altıncı fıkraları uyarınca kayda alınan beyan ve görüntüler olması durumunda verilecek ceza bir kat artırılır.
