Article 135: Recording of personal data

Book Two: Special Provisions › Part Two: Offences Against Persons › Chapter Nine: Offences against Private Life and the Confidential Sphere of Life

(1) Any person who unlawfully records personal data shall be sentenced to imprisonment from one to three years.

(2) Where the personal data relate to the political, philosophical or religious opinions or the racial origins of persons, or, unlawfully, to their moral inclinations, sexual lives, health conditions or trade union affiliations, the penalty to be imposed under the first paragraph shall be increased by one half.

MADDE 135 · Kişisel verilerin kaydedilmesi

(1) Hukuka aykırı olarak kişisel verileri kaydeden kimseye bir yıldan üç yıla kadar hapis cezası verilir.

(2) Kişisel verinin, kişilerin siyasi, felsefi veya dini görüşlerine, ırki kökenlerine; hukuka aykırı olarak ahlaki eğilimlerine, cinsel yaşamlarına, sağlık durumlarına veya sendikal bağlantılarına ilişkin olması durumunda birinci fıkra uyarınca verilecek ceza yarı oranında artırılır.
