Article 132: Violation of the confidentiality of communication

Book Two: Special Provisions › Part Two: Offences Against Persons › Chapter Nine: Offences against Private Life and the Confidential Sphere of Life

(1) Any person who violates the confidentiality of communication between persons shall be punished with imprisonment from one to three years. Where this violation of confidentiality occurs through the recording of the contents of communications, the penalty to be imposed shall be increased by one fold.

(2) Any person who unlawfully discloses the contents of communications between persons shall be punished with imprisonment from two to five years.

(3) Any person who unlawfully and publicly discloses the contents of communications made with him or her without the consent of the other party shall be punished with imprisonment from one to three years. Added sentence: 2/7/2012, Law No. 6352, Art. 79 Where such disclosed data are published through the press and broadcasting, the same penalty shall be imposed.

MADDE 132 · Haberleşmenin gizliliğini ihlal

(1) Kişiler arasındaki haberleşmenin gizliliğini ihlal eden kimse, bir yıldan üç yıla kadar hapis cezası ile cezalandırılır. Bu gizlilik ihlali haberleşme içeriklerinin kaydı suretiyle gerçekleşirse, verilecek ceza bir kat artırılır.

(2) Kişiler arasındaki haberleşme içeriklerini hukuka aykırı olarak ifşa eden kimse, iki yıldan beş yıla kadar hapis cezası ile cezalandırılır.

(3) Kendisiyle yapılan haberleşmelerin içeriğini diğer tarafın rızası olmaksızın hukuka aykırı olarak alenen ifşa eden kişi, bir yıldan üç yıla kadar hapis cezası ile cezalandırılır. (Ek cümle: 2/7/2012-6352/79 md.) İfşa edilen bu verilerin basın ve yayın yoluyla yayımlanması halinde de aynı cezaya hükmolunur.
