Article 133: Listening to and recording conversations between persons

Book Two: Special Provisions › Part Two: Offences Against Persons › Chapter Nine: Offences against Private Life and the Confidential Sphere of Life

(1) Any person who, without the consent of any of the parties, listens by means of a device to non-public conversations between persons or records them with an audio recording device shall be punished with imprisonment from two to five years.

(2) Any person who records, with an audio recording device, a non-public conversation in which he or she participates, without the consent of the other speakers, shall be punished with imprisonment from six months to two years or a judicial fine.

(3) Amended: 2/7/2012, Law No. 6352, Art. 80 Any person who unlawfully discloses data obtained through the recording of non-public conversations between persons shall be punished with imprisonment from two to five years and a judicial fine of up to four thousand days. Where such disclosed data are published through the press and broadcasting, the same penalty shall be imposed.

MADDE 133 · Kişiler arasındaki konuşmaların dinlenmesi ve kayda alınması

(1) Kişiler arasındaki aleni olmayan konuşmaları, taraflardan herhangi birinin rızası olmaksızın bir aletle dinleyen veya bunları bir ses alma cihazı ile kaydeden kişi, iki yıldan beş yıla kadar hapis cezası ile cezalandırılır.

(2) Katıldığı aleni olmayan bir söyleşiyi, diğer konuşanların rızası olmadan ses alma cihazı ile kayda alan kişi, altı aydan iki yıla kadar hapis veya adlî para cezası ile cezalandırılır.

(3) (Değişik: 2/7/2012-6352/80 md.) Kişiler arasındaki aleni olmayan konuşmaların kaydedilmesi suretiyle elde edilen verileri hukuka aykırı olarak ifşa eden kişi, iki yıldan beş yıla kadar hapis ve dörtbin güne kadar adlî para cezası ile cezalandırılır. İfşa edilen bu verilerin basın ve yayın yoluyla yayımlanması halinde de aynı cezaya hükmolunur.
