Article 97: Abandonment

Book Two: Special Provisions › Part Two: Offences Against Persons › Chapter Four: Breach of the Obligation of Protection, Supervision, Assistance or Notification

(1) Any person who abandons to his or her own fate a person who, by reason of age or illness, is unable to look after himself or herself and is therefore under an obligation of protection and supervision, shall be punished with imprisonment from three months to two years.

(2) Where, as a result of the abandonment, the victim contracts an illness, is injured or dies, the penalty shall be imposed in accordance with the provisions on offences aggravated by their consequences.

MADDE 97 · Terk

(1) Yaşı veya hastalığı dolayısıyla kendini idare edemeyecek durumda olan ve bu nedenle koruma ve gözetim yükümlülüğü altında bulunan bir kimseyi kendi haline terk eden kişi, üç aydan iki yıla kadar hapis cezası ile cezalandırılır.

(2) Terk dolayısıyla mağdur bir hastalığa yakalanmış, yaralanmış veya ölmüşse, neticesi sebebiyle ağırlaşmış suç hükümlerine göre cezaya hükmolunur.
