Article 46: Liability of the State and recourse

Chapter Three: Disqualification, Challenge and Civil Liability of Judges › Division Two: Civil Liability of the Judge

(1) An action for compensation may be brought against the State on account of the judicial activity of judges on the following grounds:

a) That an unlawful judgment or decision was rendered owing to favouritism or partiality, or owing to hatred or enmity towards one of the parties.

b) That a judgment or decision contrary to law was rendered owing to a benefit provided or promised.

c) That a decision or judgment was rendered contrary to a provision of law so clear and definite that no different meaning can be attributed to it.

ç) That a judgment was rendered on the basis of a ground not contained in the hearing record.

d) That the hearing records or the judgments or decisions were altered or falsified, or a statement not made was presented as having been made in a manner capable of affecting the judgment or decision, and a judgment was rendered on that basis.

e) That there was a refusal to administer justice.

(2) The bringing of an action for compensation may not be made conditional upon a criminal investigation being conducted against the judge or upon a conviction.

(3) On account of the compensation it has paid, the State shall have recourse against the responsible judge within one year from the date of payment.

MADDE 46 · Devletin sorumluluğu ve rücu

(1) Hâkimlerin yargılama faaliyetinden dolayı aşağıdaki sebeplere dayanılarak Devlet aleyhine tazminat davası açılabilir:

a) Kayırma veya taraf tutma yahut taraflardan birine olan kin veya düşmanlık sebebiyle hukuka aykırı bir hüküm veya karar verilmiş olması.

b) Sağlanan veya vaat edilen bir menfaat sebebiyle kanuna aykırı bir hüküm veya karar verilmiş olması.

c) Farklı bir anlam yüklenemeyecek kadar açık ve kesin bir kanun hükmüne aykırı karar veya hüküm verilmiş olması.

ç) Duruşma tutanağında mevcut olmayan bir sebebe dayanılarak hüküm verilmiş olması.

d) Duruşma tutanakları ile hüküm veya kararların değiştirilmiş yahut tahrif edilmiş veya söylenmeyen bir sözün hüküm ya da karara etkili olacak şekilde söylenmiş gibi gösterilmiş ve buna dayanılarak hüküm verilmiş olması.

e) Hakkın yerine getirilmesinden kaçınılmış olması.

(2) Tazminat davasının açılması, hâkime karşı bir ceza soruşturmasının yapılması yahut mahkûmiyet şartına bağlanamaz.

(3) Devlet, ödediği tazminat nedeniyle, sorumlu hâkime ödeme tarihinden itibaren bir yıl içinde rücu eder.
