Article 28: Default

Part Four: Consumer Contracts › Chapter Two: Consumer Credits

(1) Where, in fixed-term credit contracts, the consumer defaults in paying the instalments and the lender has reserved the right to demand performance of the entire debt, this right may be exercised only if the lender has performed all of its obligations and the consumer has defaulted in paying at least two consecutive instalments. In order for the lender to exercise this right, it is mandatory to give the consumer a warning of acceleration granting a period of at least thirty days.

(2) Interest, commission and similar charges shall not be taken into account in calculating the accelerated instalments.

MADDE 28 · Temerrüt

(1) Belirli süreli kredi sözleşmelerinde tüketicinin taksitleri ödemede temerrüde düşmesi durumunda, kredi veren, borcun tamamının ifasını talep etme hakkını saklı tutmuşsa, bu hak ancak kredi verenin bütün edimlerini ifa etmiş olması, tüketicinin de birbirini izleyen en az iki taksidi ödemede temerrüde düşmesi hâlinde kullanılabilir. Kredi verenin bu hakkı kullanabilmesi için tüketiciye en az otuz gün süre vererek muacceliyet uyarısında bulunması zorunludur.

(2) Muaccel kılınan taksitlerin hesaplanmasında faiz, komisyon ve benzeri masraflar dikkate alınmaz.
