Article 25: Interest rate

Part Four: Consumer Contracts › Chapter Two: Consumer Credits

(1) In fixed-term consumer credit contracts, the interest rate shall be determined as fixed. This rate, determined on the date the contract is concluded, cannot be changed to the detriment of the consumer.

(2) Where the contractual interest, the annual percentage rate or the total cost of the credit is not stated in consumer credit contracts, the credit amount shall be used free of interest until the end of the contract term. If the annual percentage rate has been shown lower than it actually is, the contractual interest rate to be taken as the basis for calculating the total cost of the credit shall be redetermined so as to correspond to the annual percentage rate shown lower. In these cases, the payment schedule shall be rearranged according to the changes made.

MADDE 25 · Faiz oranı

(1) Belirli süreli tüketici kredisi sözleşmelerinde faiz oranı sabit olarak belirlenir. Sözleşmenin kurulduğu tarihte belirlenen bu oran tüketici aleyhine değiştirilemez.

(2) Tüketici kredisi sözleşmelerinde, akdî faiz, efektif yıllık faiz veya kredinin toplam maliyetinin yer almaması durumunda, kredi tutarı faizsiz olarak sözleşme süresinin sonuna kadar kullanılır. Efektif faiz oranı, olduğundan düşük gösterilmişse, kredinin toplam maliyetinin hesaplanmasında esas alınacak akdî faiz oranı, düşük gösterilen efektif faiz oranına uyacak şekilde yeniden belirlenir. Bu hâllerde ödeme planı, yapılan değişikliklere göre yeniden düzenlenir.
