(1) Amended: 1/7/2022, Law No. 7416, Art. 5 The Ministry is authorised to ensure the implementation of this Law and the development of electronic commerce, to protect an effective and fair competitive environment, to make regulations concerning the activities of service providers and intermediary service providers, and to determine the elements that must be included in intermediation contracts.
(2) Added: 1/7/2022, Law No. 7416, Art. 5 For the purpose of ensuring the implementation of this Law, the Ministry is authorised to carry out inspections and to disclose the results of inspections, to appoint experts in cases requiring special expertise or technical knowledge during inspections, and to determine by regulation the procedures and principles relating to the rights and obligations of experts and their appointment. The amount of the fee to be paid to the expert shall be determined jointly by the Ministry and the Ministry of Treasury and Finance, and such fee shall be covered from the appropriation to be allocated in the Ministry's budget.
(3) Personnel assigned by the Ministry to carry out inspections are authorised, in respect of matters falling within the Ministry's authority under this Law, to request all kinds of information, documents and books, including those kept in electronic form, to examine them and take copies of them, and to obtain written and oral information from the persons concerned; and the persons concerned are obliged to provide the requested information, documents and books and their electronic records, and copies thereof, completely and truthfully, to meet requests for written and oral information, and to provide all kinds of assistance and facilities. Added sentence: 1/7/2022, Law No. 7416, Art. 5 Intermediary service providers and service providers are obliged to retain the information, documents, books and electronic records relating to their business and transactions within the scope of this Law for a period of ten years from the date on which the business or transaction took place.
(4) Added: 28/11/2017, Law No. 7061, Art. 117 Public institutions and organisations, professional organisations having the status of public institutions and other natural or legal persons shall notify the information requested by the Ministry to the system established by the Ministry in order to enable the development of electronic commerce to be monitored and evaluated.
(5) Added: 28/11/2017, Law No. 7061, Art. 117 The Ministry is authorised to establish, or have established, an electronic system enabling consents for commercial electronic messages to be obtained and the right of refusal to be exercised. Consents obtained under this Law shall be transferred to the system within the period determined by the Ministry. Consents that are not transferred to the system shall be deemed invalid. Recipients shall check the consents registered in the system within the period determined by the Ministry. Commercial electronic messages sent after the expiry of this period shall be deemed to have been consented to. The right of refusal shall be exercised by recipients through this system. The establishment of the system, the transfer of consents to the system, their retention, the exercise of the right of refusal through the system and other procedures and principles relating to the operation of the system shall be determined by regulation.
(6) Added: 1/7/2022, Law No. 7416, Art. 5 The Ministry is authorised to determine the procedures and principles relating to the application to intermediary service providers of the obligations set out in Articles 3, 4, 5, 6, 7 and 8.
(7) Added: 1/7/2022, Law No. 7416, Art. 5 The Ministry is authorised to obtain from the Information and Communication Technologies Authority the subscriber information of natural or legal persons sending commercial electronic messages by voice call and short message.

MADDE 11 · Bakanlık yetkisi
(1) (Değişik:1/7/2022-7416/5 md.) Bakanlık, bu Kanunun uygulanmasını ve elektronik ticaretin gelişimini sağlamaya, etkin ve adil rekabet ortamını korumaya, hizmet sağlayıcı ve aracı hizmet sağlayıcının faaliyetlerine yönelik düzenleme yapmaya ve aracılık sözleşmesinde yer verilmesi zorunlu unsurları belirlemeye yetkilidir.
(2) (Ek:1/7/2022-7416/5 md.) Bakanlık, bu Kanunun uygulanmasını sağlamak amacıyla denetim yapmaya ve denetim sonuçlarını açıklamaya, denetim sırasında özel uzmanlık veya teknik bilgi gerektiren durumlarda bilirkişi görevlendirmeye, bilirkişinin hak ve yükümlülükleri ile görevlendirilmesine ilişkin usul ve esasları yönetmelikle belirlemeye yetkilidir. Bilirkişiye verilecek ücretin tutarı Bakanlık ile Hazine ve Maliye Bakanlığınca birlikte tespit olunur ve bu ücret Bakanlık bütçesine konulacak ödenekten karşılanır.
(3) Bakanlıkça denetimle görevlendirilen personel, bu Kanun kapsamında Bakanlık yetkisine giren hususlarla ilgili olarak elektronik ortamda tutulanlar dâhil olmak üzere her türlü bilgi, belge ve defterleri istemeye, bunları incelemeye ve örneklerini almaya, ilgililerden yazılı ve sözlü bilgi almaya yetkili olup ilgililer istenilen bilgi, belge ve defterler ile elektronik kayıtlarını, bunların örneklerini noksansız ve gerçeğe uygun olarak vermek, yazılı ve sözlü bilgi taleplerini karşılamak ve her türlü yardım ve kolaylığı göstermekle yükümlüdür. (Ek cümle:1/7/2022-7416/5 md.) Aracı hizmet sağlayıcı ve hizmet sağlayıcı, bu Kanun kapsamındaki iş ve işlemlerine ilişkin bilgi, belge, defter ve elektronik kayıtlarını, iş veya işlemin gerçekleştiği tarihten itibaren on yıl süreyle saklamakla yükümlüdür.
(4) (Ek:28/11/2017-7061/117 md.) Kamu kurum ve kuruluşları, kamu kurumu niteliğindeki meslek kuruluşları ve diğer gerçek veya tüzel kişiler, elektronik ticaretin gelişiminin izlenebilmesi ve değerlendirilebilmesi amacıyla Bakanlık tarafından istenilen bilgileri Bakanlıkça oluşturulan sisteme bildirir.
(5) (Ek:28/11/2017-7061/117 md.) Bakanlık, ticari elektronik ileti onaylarının alınmasına ve reddetme hakkının kullanılmasına imkân tanıyan bir elektronik sistem kurmaya veya kurdurmaya yetkilidir. Bu Kanun çerçevesinde alınan onaylar Bakanlıkça belirlenen süre içinde sisteme aktarılır. Sisteme aktarılmayan onaylar geçersiz kabul edilir. Alıcılar, sisteme kaydedilen onayları Bakanlıkça belirlenen süre içinde kontrol eder. Bu sürenin bitiminden sonra gönderilen ticari elektronik iletiler onaylı kabul edilir. Alıcılar tarafından reddetme hakkı bu sistem üzerinden kullanılır. Sistemin kurulması, onayların sisteme aktarılması, saklanması, reddetme hakkının sistem üzerinden kullanılması ve sistemin işleyişine ilişkin diğer usul ve esaslar yönetmelikle belirlenir.
(6) (Ek:1/7/2022-7416/5 md.) Bakanlık, 3 üncü, 4 üncü, 5 inci, 6 ncı, 7 nci ve 8 inci maddelerde düzenlenen yükümlülüklerin aracı hizmet sağlayıcılara uygulanmasına ilişkin usul ve esasları belirlemeye yetkilidir.
(7) (Ek:1/7/2022-7416/5 md.) Bakanlık, sesli arama ve kısa mesaj yoluyla ticari elektronik ileti gönderen gerçek veya tüzel kişi abone bilgilerini Bilgi Teknolojileri ve İletişim Kurumundan almaya yetkilidir.
