(1) Where the application is evaluated favourably, the foreigner shall be granted, upon the first application, a work permit valid for a maximum of one year, provided that it does not exceed the term of the employment or service contract, on condition that he or she works in a specific job at a specific workplace belonging to a natural or legal person or to a public institution or organisation, or at their workplaces in the same branch of activity.
(2) Where an extension application made in accordance with Article 7 of this Law is evaluated favourably, the foreigner shall be granted a work permit, dependent on the same employer, for a maximum of two years upon the first extension application and for up to a maximum of three years upon subsequent extension applications. However, applications made in order to work for a different employer shall be evaluated within the scope of paragraph 1 of this Article.
(3) Foreigners who hold a long-term residence permit or who have a legal work permit period of at least eight years in Türkiye may apply for an indefinite work permit. However, the fulfilment of the application conditions by the foreigner does not confer an absolute right on the foreigner.
(4) A foreigner holding an indefinite work permit shall benefit from all the rights provided by the long-term residence permit. A foreigner holding an indefinite work permit shall, except for the provisions in special laws, benefit from the rights granted to Turkish citizens, on condition that his or her acquired rights relating to social security are reserved and that he or she is subject to the provisions of the relevant legislation in the exercise of these rights. A foreigner holding an indefinite work permit does not have the right to vote, to be elected and to enter public service, nor the obligation to perform military service.
(5) Foreigners who are, in companies established in accordance with the Turkish Commercial Code No. 6102 dated 13/1/2011;
a) The manager who is a shareholder of a limited liability company,
b) The member of the board of directors who is a shareholder of a joint-stock company,
c) The general partner who is the manager of a partnership limited by shares,
may work by obtaining a work permit.
(6) Foreigners who are members of a profession may be granted an independent work permit, provided that the special conditions specified in other laws are met.
(7) In the evaluation of an independent work permit in line with the international labour force policy, the foreigner's level of education, professional experience, contribution to science and technology, the impact of his or her activity or investment in Türkiye on the national economy and employment, his or her share of capital if he or she is a shareholder of a foreign company, and other matters to be determined by the Ministry in line with the recommendations of the International Labour Force Policy Advisory Board shall be taken into account.
(8) An independent work permit shall be issued for a fixed period without being subject to the time limitations set out in this Article.

MADDE 10 · Çalışma izni türleri
(1) Başvurunun olumlu değerlendirilmesi hâlinde yabancıya, iş veya hizmet sözleşmesinin süresini aşmamak koşuluyla, gerçek veya tüzel kişiye ya da kamu kurum veya kuruluşuna ait belirli bir işyerinde veya bunların aynı işkolundaki işyerlerinde belirli bir işte çalışmak şartıyla ilk başvuruda en çok bir yıl geçerli çalışma izni verilir.
(2) Bu Kanunun 7 nci maddesine göre yapılacak uzatma başvurusunun olumlu değerlendirilmesi hâlinde yabancıya aynı işverene bağlı olarak ilk uzatma başvurusunda en çok iki yıl, sonraki uzatma başvurularında ise en çok üç yıla kadar çalışma izni verilir. Ancak, farklı bir işveren yanında çalışmak üzere yapılan başvurular bu maddenin birinci fıkrası kapsamında değerlendirilir.
(3) Türkiye’de uzun dönem ikamet izni veya en az sekiz yıl kanuni çalışma izni olan yabancılar süresiz çalışma iznine başvurabilir. Ancak, yabancının başvuru şartlarını taşıması yabancıya mutlak hak sağlamaz.
(4) Süresiz çalışma izni olan yabancı, uzun dönem ikamet izninin sağladığı tüm haklardan yararlanır. Süresiz çalışma izni olan yabancı, özel kanunlardaki düzenlemeler hariç, sosyal güvenliğe ilişkin kazanılmış hakları saklı kalmak ve bu hakların kullanımında ilgili mevzuat hükümlerine tabi olmak şartıyla, Türk vatandaşlarına tanınan haklardan yararlanır. Süresiz çalışma izni olan yabancının seçme, seçilme ve kamu görevlerine girme hakkı ile askerlik hizmeti yapma yükümlülüğü yoktur.
(5) 13/1/2011 tarihli ve 6102 sayılı Türk Ticaret Kanununa göre kurulmuş olan;
a) Limited şirketlerin şirket ortağı olan müdürü,
b) Anonim şirketlerin şirket ortağı olan yönetim kurulu üyesi,
c) Sermayesi paylara bölünmüş komandit şirketlerin yönetici olan komandite ortağı,
olan yabancılar çalışma izni alarak çalışabilirler.
(6) Profesyonel meslek mensubu yabancılara, diğer kanunlarda belirtilen özel şartların sağlanması kaydıyla bağımsız çalışma izni verilebilir.
(7) Bağımsız çalışma izninin uluslararası işgücü politikası doğrultusunda değerlendirilmesinde, yabancının; eğitim düzeyi, mesleki deneyimi, bilim ve teknolojiye katkısı, Türkiye’deki faaliyetinin veya yatırımının ülke ekonomisine ve istihdama etkisi, yabancı şirket ortağı ise sermaye payı ile Uluslararası İşgücü Politikası Danışma Kurulu önerileri doğrultusunda Bakanlıkça belirlenecek diğer hususlar dikkate alınır.
(8) Bağımsız çalışma izni, bu maddede yer alan süre sınırlamalarına tabi olmaksızın süreli olarak düzenlenir.
