Article 6/A: Association of Access Providers

(1) The Association of Access Providers has been established in order to ensure the implementation of decisions on the removal of content and/or blocking of access relating to all content outside the scope of Articles 8 and 8/A of this Law.

(2) The Association has legal personality under private law. The headquarters of the Association is Ankara.

(3) The working procedures and principles of the Association and the fields of activity of the Association, including matters of conscious and safe use of the internet, shall be determined by the Statute to be approved by the Presidency. Amendments to the Statute are also subject to the approval of the Presidency.

(4) The Association shall commence its activities following the examination and approval of its Statute by the Presidency.16

(5) The Association is an organisation formed by the participation of all internet service providers authorised within the scope of the Electronic Communications Law No. 5809 dated 5/11/2008 and other operators providing internet access services, and it ensures coordination.

(6) Decisions to block access shall be implemented by access providers. All hardware and software necessary for the implementation of the decisions shall be provided by the access providers themselves.

(7) Decisions to block access shall be sent to the Association for execution. Service made to the Association in this context shall be deemed to have been made to the access providers. Added sentence: 13/10/2022, Law No. 7418, Art. 31 Access providers are obliged to establish the technical infrastructure necessary for the notification of decisions.

(8) The Association may object to decisions sent to it which it considers not to be in conformity with the legislation.

(9) The revenues of the Association consist of fees to be paid by its members, donations and other activity revenues. The fees to be collected from members shall be determined in an amount sufficient to cover the expenses of the Association. The fee to be paid by a member shall be determined in proportion to that member's net sales within the total net sales of all members. The payment periods of members, the time from which newly joining members shall start to pay and other matters relating to payments shall be determined in the Statute of the Association. Fees not paid on time shall be collected by the Association together with statutory interest.

(10) Internet service providers that are not members of the Association may not operate.

(11) Added: 13/10/2022, Law No. 7418, Art. 31 The Association may notify decisions on the removal of content and/or blocking of access to the electronic mail addresses of the relevant content or hosting provider that can be identified from their web pages.

MADDE 6/A · Erişim Sağlayıcıları Birliği

(Ek: 6/2/2014-6518/90 md.)

(1) Bu Kanunun 8 ve 8/A maddeleri kapsamı dışındaki tüm içeriğin çıkarılması ve/veya erişimin engellenmesine yönelik kararların uygulanmasını sağlamak üzere Erişim Sağlayıcıları Birliği kurulmuştur.

(2) Birlik özel hukuk tüzel kişiliğini haizdir. Birliğin merkezi Ankara’dır.

(3) Birliğin çalışma usul ve esasları ile internetin bilinçli ve güvenli kullanımı konuları da dâhil olmak üzere Birliğin faaliyet alanları, Başkanlık tarafından onaylanacak Tüzükle belirlenir. Tüzük değişiklikleri de Başkanlığın onayına tabidir.

(4) Birlik, Tüzüğünün Başkanlık tarafından incelenerek uygun bulunmasını müteakip faaliyete başlar.16

(5) Birlik, 5/11/2008 tarihli ve 5809 sayılı Elektronik Haberleşme Kanunu kapsamında yetkilendirilen tüm internet servis sağlayıcıları ile internet erişim hizmeti veren diğer işletmecilerin katılmasıyla oluşan ve koordinasyonu sağlayan bir kuruluştur.

(6) Erişimin engellenmesi kararları erişim sağlayıcılar tarafından yerine getirilir. Kararların uygulanması amacıyla gerekli her türlü donanım ve yazılım erişim sağlayıcıların kendileri tarafından sağlanır.

(7) Erişimin engellenmesi kararları gereği için Birliğe gönderilir. Bu kapsamda Birliğe yapılan tebligat erişim sağlayıcılara yapılmış sayılır. (Ek cümle:13/10/2022-7418/31 md.) Erişim sağlayıcılar, kararların bildirimi için gerekli teknik altyapıyı kurmakla yükümlüdür.

(8) Birlik, kendisine gönderilen mevzuata uygun olmadığını düşündüğü kararlara itiraz edebilir.

(9) Birliğin gelirleri, üyeleri tarafından ödenecek ücretlerden, bağış ve diğer faaliyet gelirlerinden oluşur. Üyelerden alınacak ücretler, Birliğin giderlerini karşılayacak miktarda belirlenir. Bir üyenin ödeyeceği ücret, üyelerin tamamının net satış tutarı toplamı içindeki o üyenin net satışı oranında belirlenir. Üyelerin ödeme dönemleri, yeni katılan üyelerin ne zamandan itibaren ödemeye başlayacağı ve ödemelere ilişkin diğer hususlar Birlik Tüzüğünde belirlenir. Süresinde ödenmeyen ücretler Birlikçe kanuni faizi ile birlikte tahsil edilir.

(10) Birliğe üye olmayan internet servis sağlayıcıları faaliyette bulunamaz.

(11) (Ek:13/10/2022-7418/31 md.) Birlik, içeriğin çıkarılması ve/veya erişimin engellenmesi kararlarını, ilgili içerik veya yer sağlayıcının internet sayfalarından tespit edilebilen elektronik posta adreslerine bildirebilir.
