Article 945: 3. Liability of the creditor

The creditor is liable for damage resulting from the loss, destruction or diminution in value of the pledged movable, unless he proves that it occurred without his fault.

A creditor who, on his own initiative, transfers or pledges the pledged movable to another person shall be liable for all damage arising therefrom.

MADDE 945 · 3. Alacaklının sorumluluğu

Alacaklı, rehinli taşınırın kaybolması, yok olması veya değerinin azalması yüzünden meydana gelen zararlardan, bunların kendi kusuru olmaksızın doğduğunu ispat etmedikçe sorumludur.

Rehinli taşınırı kendiliğinden başkasına devir veya rehneden alacaklı, bundan doğan bütün zararlardan sorumlu olur.
