Article 128: B. Undertaking the act of a third party

Chapter Two: Effects of Obligations › Division Three: Effect of Obligatory Relationships on Third Parties

A person who undertakes towards another the act of a third party shall be liable to compensate the damage arising from the non-occurrence of that act.

In an undertaking made for a specific period, it may be agreed that the liability of the person giving the undertaking shall end if no written request for performance is made to that person before the expiry of the period.

MADDE 128 · B. Üçüncü kişinin fiilini üstlenme

Üçüncü bir kişinin fiilini başkasına karşı üstlenen, bu fiilin gerçekleşmemesinden doğan zararı gidermekle yükümlüdür.

Belirli bir süre için yapılan üstlenmede, sürenin bitimine kadar üstlenene edimini ifa etmesi için yazılı olarak başvurulmaması hâlinde, üstlenenin sorumluluğunun sona ereceği kararlaştırılabilir.
