Article 119: b. Liability for fortuitous events

Chapter Two: Effects of Obligations › Division Two: Consequences of Non-Performance of Obligations A. Non-performance of the obligation I. Obligation to compensate

A debtor in default shall be liable for damage arising from fortuitous events.

The debtor may be released from this liability by proving that the debtor bears no fault for falling into default or that the fortuitous event would have damaged the subject matter of performance even if the debtor had performed the obligation in time.

MADDE 119 · b. Beklenmedik hâlden sorumluluk

Temerrüde düşen borçlu, beklenmedik hâl sebebiyle doğacak zarardan sorumludur.

Borçlu, temerrüde düşmekte kusuru olmadığını veya borcunu zamanında ifa etmiş olsaydı bile beklenmedik hâlin ifa konusu şeye zarar vereceğini ispat ederek bu sorumluluktan kurtulabilir.
