Article 121: b. Default interest on interest, annuities and donations

Chapter Two: Effects of Obligations › Division Two: Consequences of Non-Performance of Obligations A. Non-performance of the obligation I. Obligation to compensate

A debtor who is in default in paying interest or an annuity, or a sum of money that the debtor has donated, shall be liable to pay default interest starting from the day on which enforcement proceedings are initiated or an action is brought.

Agreements made to the contrary shall be subject to the provisions on penalty clauses.

Default interest may not be charged on default interest.

MADDE 121 · b. Faizlerde, iratlarda ve bağışlamada temerrüt faizi

Faiz veya irat borcunu ya da bağışladığı bir miktar parayı ödemekte temerrüde düşen borçlu, icra takibine girişildiği veya dava açıldığı günden başlayarak, temerrüt faizi ödemekle yükümlüdür.

Buna aykırı olarak yapılan anlaşmalar, ceza koşulu hükümlerine tabi olur.

Temerrüt faizine, ayrıca temerrüt faizi yürütülemez.
