Article 124: b. Cases not requiring a time limit

Chapter Two: Effects of Obligations › Division Two: Consequences of Non-Performance of Obligations A. Non-performance of the obligation I. Obligation to compensate

No time limit need be granted in the following cases:

1. Where it is apparent from the situation or conduct of the debtor that granting a time limit would be ineffective.

2. Where, as a result of the debtor's default, performance of the obligation has become useless to the creditor.

3. Where it is apparent from the contract that performance will no longer be accepted if the obligation is not performed at a specific time or within a specific period.

MADDE 124 · b. Süre verilmesini gerektirmeyen durumlar

Aşağıdaki durumlarda süre verilmesine gerek yoktur:

1. Borçlunun içinde bulunduğu durumdan veya tutumundan süre verilmesinin etkisiz olacağı anlaşılıyorsa.

2. Borçlunun temerrüdü sonucunda borcun ifası alacaklı için yararsız kalmışsa.

3. Borcun ifasının, belirli bir zamanda veya belirli bir süre içinde gerçekleşmemesi üzerine, ifanın artık kabul edilmeyeceği sözleşmeden anlaşılıyorsa.
