Where one of the parties prevents the fulfilment of the condition contrary to the rules of good faith, the condition shall be deemed fulfilled.

MADDE 175 · II. Dürüstlük kurallarına aykırı engelleme
Taraflardan biri, koşulun gerçekleşmesine dürüstlük kurallarına aykırı olarak engel olursa, koşul gerçekleşmiş sayılır.
Taraflardan biri, koşulun gerçekleşmesini dürüstlük kurallarına aykırı biçimde sağlarsa, koşul gerçekleşmemiş sayılır.
