Article 171: II. Position while the condition is pending

Chapter Four: Special Situations in Obligational Relationships › Division Two: Conditions A. Condition precedent

Until the condition is fulfilled, the debtor shall be obliged to refrain from any conduct that would prevent the due performance of the obligation.

A creditor whose conditional right is endangered may take the measures that creditors whose claims are unconditional may take to protect their rights.

Dispositions made before the fulfilment of the condition shall be invalid to the extent that they impair the effects of the condition.

MADDE 171 · II. Koşulun askıda olduğu sıradaki durum

Koşul gerçekleşinceye kadar borçlu, borcun gereği gibi ifasını engelleyecek her türlü davranıştan kaçınmakla yükümlüdür.

Koşula bağlı hakkı tehlikeye düşürülen alacaklı, alacağı koşula bağlı olmayan alacaklıların haklarını korumak üzere başvurabilecekleri önlemleri alabilir.

Koşulun gerçekleşmesinden önce yapılan tasarruflar, koşulun hükümlerini zedelediği oranda geçersiz olur.
