The agreed penalty shall be payable even if the creditor has suffered no damage.
Where the damage suffered by the creditor exceeds the amount of the agreed penalty, the creditor may not claim the excess amount unless he proves that the debtor was at fault.

MADDE 180 · 2. Ceza ile zarar arasındaki ilişki
Alacaklı hiçbir zarara uğramamış olsa bile, kararlaştırılan cezanın ifası gerekir.
Alacaklının uğradığı zarar kararlaştırılan ceza tutarını aşıyorsa alacaklı, borçlunun kusuru bulunduğunu ispat etmedikçe aşan miktarı isteyemez.
