Article 200: D. Nullity of the agreement

Chapter Five: Changes of Parties in Obligational Relationships › Division Two: Assumption of Debt

Where the external assumption of debt agreement becomes null and void, the former debt shall continue to exist together with all its accessory obligations, without prejudice to the rights of third persons acting in good faith.

Furthermore, unless the person who assumed the debt proves that no fault can be attributed to him for the agreement becoming null and void and for the damage suffered by the creditor, the creditor may claim from the assuming party compensation for the damage he has suffered due to the loss of previously provided security or for any other reason.

MADDE 200 · D. Sözleşmenin hükümsüzlüğü

Dış üstlenme sözleşmesi hükümsüz hâle gelirse, iyiniyetli üçüncü kişilerin hakları saklı kalmak üzere, eski borç bütün bağlı borçlarıyla birlikte varlığını sürdürür.

Bundan başka, borcu üstlenen üstlenme sözleşmesinin hükümsüz hâle gelmesinde ve alacaklının zarara uğramasında kendisine bir kusur yüklenemeyeceğini ispat etmedikçe alacaklı, önceden sağlanmış güvenceyi yitirmesi yüzünden veya başka herhangi bir sebeple uğradığı zararın giderilmesini üstlenenden isteyebilir.
