Article 199: II. Defences

Chapter Five: Changes of Parties in Obligational Relationships › Division Two: Assumption of Debt

The right to raise defences relating to the assumed debt shall pass to the new debtor.

Unless otherwise evident from the external assumption of debt agreement, the new debtor may not raise against the creditor the personal defences that the former debtor could have raised.

The new debtor may not raise against the creditor the defences arising from the internal assumption of debt agreement.

MADDE 199 · II. Savunmalar

Üstlenilen borca ilişkin savunmaları ileri sürme hakkı, yeni borçluya geçer.

Dış üstlenme sözleşmesinden aksi anlaşılmadıkça yeni borçlu, alacaklıya karşı önceki borçlunun ileri sürebileceği kişisel savunmalarda bulunamaz.

Yeni borçlu, iç üstlenme sözleşmesinden kaynaklanan savunmaları alacaklıya karşı ileri süremez.
