Article 198: I. Accessory rights and obligations

Chapter Five: Changes of Parties in Obligational Relationships › Division Two: Assumption of Debt

Even where the debtor has changed, the creditor's accessory rights, other than those specific to the person of the debtor, shall remain reserved.

However, the liabilities of a third person who gave a pledge as security for the debt and of a surety shall continue only if they consent in writing to the assumption of the debt.

MADDE 198 · I. Bağlı hak ve borçlar

Borçlu değişmiş olsa bile, alacaklının borçlunun kişiliğine özgü olanlar dışındaki bağlı hakları saklı kalır.

Bununla birlikte borcun güvencesi olarak rehin veren üçüncü kişinin ve kefilin sorumlulukları, ancak onların borcun üstlenilmesine yazılı olarak rıza göstermeleri hâlinde devam eder.
