Article 328: 1. In general

Part Two: Special Obligational Relationships › Chapter Four: Lease Contract › Division One: General Provisions

In lease contracts of indefinite duration, either party may terminate the contract by observing the statutory termination dates and notice periods, unless a longer notice period or another termination date has been agreed. In calculating the termination dates, the commencement date of the lease contract shall be taken as the basis.

If the termination date or notice period specified in the contract or by law has not been observed, the notice shall take effect for the next termination date.

MADDE 328 · 1. Genel olarak

Belirsiz süreli kira sözleşmelerinde taraflardan her biri, daha uzun bir fesih bildirim süresi veya başka bir fesih dönemi kararlaştırılmış olmadıkça, yasal fesih dönemlerine ve fesih bildirim sürelerine uyarak sözleşmeyi feshedebilir. Fesih dönemlerinin hesabında, kira sözleşmesinin başlangıç tarihi esas alınır.

Sözleşmede veya kanunda belirtilen fesih dönemine veya bildirim süresine uyulmamışsa, bildirim bir sonraki fesih dönemi için geçerli olur.
