Article 446: Disciplinary fine

Part Twelve: Final Provisions

(1) Within the meaning of this Code, a disciplinary fine means a fine imposed in order to ensure the orderly conduct of proceedings and to protect public order, which is final as soon as it is imposed and must be executed immediately. This fine may not be converted into alternative sanctions and shall not be entered in the criminal records.

(2) The disciplinary fine shall be collected in accordance with the provisions of the Law No. 6183 on the Procedure for the Collection of Public Receivables dated 21/7/1953.

MADDE 446 · Disiplin para cezası

(1) Bu Kanun anlamında disiplin para cezasından maksat, yargılamanın düzenli bir biçimde işleyişini sağlamak ve kamu düzenini korumak amacıyla verilen, verildiği anda kesin olan ve derhâl infazı gereken para cezasıdır. Bu ceza, seçenek yaptırımlara çevrilemez ve adli sicil kayıtlarında yer almaz.

(2) Disiplin para cezası, 21/7/1953 tarihli ve 6183 sayılı Amme Alacaklarının Tahsil Usulü Hakkında Kanun hükümlerine göre tahsil edilir.
