Chapter Four: Parties and Third Parties Joining the Action › Division One: Capacities of the Parties
(1) In the event of the death of one of the parties, if the heirs have not accepted or renounced the estate, the action shall be stayed until the time limits prescribed by law in this respect have expired. Nevertheless, in cases where delay would be prejudicial, the judge may, upon request, decide to appoint a curator to conduct the action.

MADDE 55 · Dava sırasında taraflardan birinin ölümü
(1) Taraflardan birinin ölümü hâlinde, mirasçılar mirası kabul veya reddetmemişse, bu hususta kanunla belirlenen süreler geçinceye kadar dava ertelenir. Bununla beraber hâkim, gecikmesinde sakınca bulunan hâllerde, talep üzerine davayı takip için kayyım atanmasına karar verebilir.
