Article 73: Consumer courts

Part Eight: Provisions on Adjudication, Supervision and Penalties

(1) Consumer courts shall have jurisdiction over actions concerning disputes that may arise from consumer transactions and from practices directed at consumers.

(2) Actions brought before consumer courts by the Ministry, consumers and consumer organisations shall be exempt from the fees regulated in the Fees Law No. 492 dated 2/7/1964.

(3) In actions to be brought by umbrella organisations of consumer organisations, the expert fee and, where the action is concluded against the claimant, the attorney's fee awarded shall be covered by the Ministry. Where the action is concluded against the defendant, the expert fee shall be collected from the defendant in accordance with the provisions of the Law on the Procedure for the Collection of Public Receivables and recorded as revenue in the budget.

(4) Actions to be heard in consumer courts shall be conducted in accordance with the provisions of Part Six of the Code of Civil Procedure No. 6100 dated 12/1/2011.

(5) Consumer actions may also be brought before the consumer court of the place where the consumer's domicile is located.

(6) Consumer organisations, the relevant public institutions and organisations and the Ministry may, except for the provisions relating to unfair commercial practices and commercial advertisements, bring actions before consumer courts, in cases which concern consumers in general and where there is a danger of a situation contrary to this Law arising, for obtaining an interim injunction to prevent or stop such situation, or for the determination, prevention or cessation of the unlawful situation.

(7) In actions concerning consumers in general, the claimant may request the publication of the decisions rendered. If the request is accepted by the court, the decision shall be announced forthwith in at least three newspapers published nationwide, with the costs to be borne by the defendant.

(8) Final decisions rendered by consumer courts shall be transmitted to the Ministry through the National Judiciary Informatics System. Decisions rendered upon objections against decisions of consumer arbitration committees shall be sent by the court rendering the decision to the relevant consumer arbitration committee.

MADDE 73 · Tüketici mahkemeleri

(1) Tüketici işlemleri ile tüketiciye yönelik uygulamalardan doğabilecek uyuşmazlıklara ilişkin davalarda tüketici mahkemeleri görevlidir.

(2) Tüketici mahkemeleri nezdinde Bakanlık, tüketiciler ve tüketici örgütleri tarafından açılan davalar 2/7/1964 tarihli ve 492 sayılı Harçlar Kanununda düzenlenen harçlardan muaftır.

(3) Tüketici örgütleri üst kuruluşlarınca açılacak davalarda bilirkişi ücreti ve davanın davacı aleyhine sonuçlanması durumunda, hükmedilen vekâlet ücreti Bakanlıkça karşılanır. Davanın, davalı aleyhine sonuçlanması durumunda, bilirkişi ücreti Amme Alacaklarının Tahsil Usulü Hakkında Kanun hükümlerine göre davalıdan tahsil olunarak bütçeye gelir kaydedilir.

(4) Tüketici mahkemelerinde görülecek davalar 12/1/2011 tarihli ve 6100 sayılı Hukuk Muhakemeleri Kanununun Altıncı Kısım hükümlerine göre yürütülür.

(5) Tüketici davaları, tüketicinin yerleşim yerinin bulunduğu yerdeki tüketici mahkemesinde de açılabilir.

(6) Tüketici örgütleri, ilgili kamu kurum ve kuruluşları ile Bakanlık; haksız ticari uygulamalar ve ticari reklamlara ilişkin hükümler dışında, genel olarak tüketicileri ilgilendiren ve bu Kanuna aykırı bir durumun doğma tehlikesi olan hâllerde bunun önlenmesine veya durdurulmasına ilişkin ihtiyati tedbir kararı alınması veya hukuka aykırı durumun tespiti, önlenmesi veya durdurulması amacıyla tüketici mahkemelerinde dava açabilir.

(7) Genel olarak tüketicileri ilgilendiren davalarda davacı, verilen kararların yayımlanmasını talep edebilir. Talebin mahkemece kabul edilmesi hâlinde bu karar, masrafları davalıdan alınmak üzere ülke düzeyinde yayımlanan gazetelerden en az üçünde derhâl ilan edilir.

(8) Tüketici mahkemelerince verilen kesinleşmiş kararlar, Ulusal Yargı Ağı Bilişim Sistemi üzerinden Bakanlığa iletilir. Tüketici hakem heyetleri kararlarına karşı yapılan itiraz sonucu verilen kararlar, kararı veren mahkeme tarafından ilgili tüketici hakem heyetine gönderilir.
