(1) In actions brought for receivables and compensation of the employee or employer based on law or on an individual or collective employment agreement, and in actions brought with a request for reinstatement, recourse to a mediator shall be a condition of action. Added sentence: 28/3/2023, Law No. 7445, Art. 41 The provision of the first sentence shall apply to actions for the annulment of an objection, negative declaratory actions and actions for restitution relating to such receivables and compensation.
(2) The claimant shall be obliged to attach to the statement of claim the original of the final report stating that no agreement could be reached at the end of the mediation process, or a copy thereof certified by the mediator. In case of failure to comply with this obligation, the court shall send the claimant a summons containing a warning that the final report must be submitted to the court within a definitive time limit of one week, failing which the action shall be dismissed on procedural grounds. If the requirement of the warning is not fulfilled, the court shall decide to dismiss the action on procedural grounds without serving the statement of claim on the opposing party. Where it is understood that the action has been brought without recourse to a mediator, the court shall decide, without taking any further step, to dismiss the action on procedural grounds owing to the absence of a condition of action.
(3) The provision of paragraph 1 shall not apply to actions for pecuniary and non-pecuniary compensation arising from an occupational accident or occupational disease, or to related actions for declaratory judgment, objection and recourse.
(4) The Mediation Department shall list the mediators registered in the registry who wish to act as mediators under this article, indicating their fields of expertise, if any, according to the justice commissions of the judicial courts of first instance where they wish to serve, and shall notify the lists to the presidencies of the relevant commissions. The presidencies of the commissions shall send these lists to the mediation offices within their judicial districts, and in places where no mediation office has been established, to the chief clerk's office of the civil court of peace which they designate.
(5) The application shall be made to the mediation office at the domicile of the opposing party or, where there is more than one opposing party, of one of them, or at the place where the work is performed, and in places where no mediation office has been established, to the designated chief clerk's office.
(6) The mediator shall be determined by the office from the list notified to the presidencies of the commissions. However, if the parties agree on any mediator included in the list, that mediator shall be appointed.
(7) The applying party shall provide the mediation office with all contact information relating to himself and, if available to him, to the opposing party. The office shall also be authorised to research the contact information of the parties contained in official records. The relevant institutions and organisations shall be obliged to provide the information and documents requested by the office.
(8) The contact information of the parties shall be provided by the office to the appointed mediator. The mediator shall rely on this contact information and may also conduct research of his own motion when needed. On the basis of the information available to him, he shall inform the parties of the appointment by using all kinds of means of communication and shall invite them to the first meeting. He shall document his actions relating to the notification and invitation.
(9) The mediator may not of his own motion take into account whether the office making the appointment has jurisdiction. The opposing party may object to the jurisdiction of the mediation office at the latest at the first meeting by submitting documents relating to his domicile and the place where the work is performed. In this case, the mediator shall immediately deliver the file to the office to be sent to the relevant civil court of peace. The court shall, at the end of an examination conducted on the file without charging any fee, rule definitively on the competent office and shall return the file to the office. The court decision shall be served on the parties by the office in accordance with the provisions of the Law on Service of Documents No. 7201 of 11/2/1959. If the objection to jurisdiction is rejected, the same mediator shall be appointed again and the time limits specified in paragraph 10 shall start from the date of the new appointment. If the objection to jurisdiction is accepted, an application may be made to the competent office within one week from the service of the decision. In that case, the date of application to the non-competent office shall be deemed to be the date of application to the competent office. The competent office shall appoint a mediator in accordance with paragraph 6.
(10) The mediator shall conclude the application within three weeks from the date of his appointment. In compelling circumstances, this period may be extended by the mediator by a maximum of one week.
(11) Where the parties cannot be reached, where no meeting can be held because the parties do not attend, or where, as a result of the meetings held, an agreement is reached or is not reached, the mediator shall terminate the mediation process, draw up the final report and immediately notify the mediation office of the situation.
(12) Where the mediation process is terminated because one of the parties fails to attend the first meeting without showing a valid excuse, the party who did not attend the meeting shall be indicated in the final report, and that party shall be held liable for half of the litigation costs that the opposing party is obliged to pay, even if it is found partially or wholly justified in the action. Amended second sentence: 7/11/2024, Law No. 7531, Art. 28 Furthermore, half of the attorney's fee determined according to the Minimum Attorneys' Fee Tariff shall be awarded in favour of that party. In actions brought following a mediation process terminated because neither party attended the first meeting, the litigation costs incurred by the parties shall be borne by themselves.
(13) Where the parties reach an agreement at the end of the mediation process, the mediation fee shall, unless otherwise agreed, be borne equally by the parties in accordance with the Second Part of the Mediation Fee Tariff annexed to the Minimum Mediation Fee Tariff. In this case, the fee may not be less than the two-hour fee amount determined in the First Part of the Tariff. Where the parties reach an agreement in meetings held with a request for reinstatement, in determining the fee payable to the mediator, the sum of the compensation payable in case the employee is not reinstated and the wages and other entitlements payable for the period during which the employee was not employed shall be deemed to be the amount agreed upon under the Second Part of the Tariff.
(14) Where, at the end of the mediation process, the parties cannot be reached, no meeting can be held because the parties do not attend, or the parties fail to reach an agreement at the end of meetings lasting less than two hours, the two-hour fee amount shall be paid from the budget of the Ministry of Justice in accordance with the First Part of the Tariff. Where the parties fail to reach an agreement at the end of meetings lasting more than two hours, the fee for the portion exceeding two hours shall, unless otherwise agreed, be borne equally by the parties in accordance with the First Part of the Tariff. The mediation fee paid from the budget of the Ministry of Justice and borne by the parties shall be counted among the litigation costs.

(16) The necessary expenses to be incurred by the mediation office under this article shall be covered from the budget of the Ministry of Justice, to be paid by the parties in accordance with the agreement where an agreement is reached at the end of the mediation process, and to be collected from the party subsequently found to be in the wrong where no agreement is reached.
(17) During the period from the application to the mediation office until the date on which the final report is drawn up, limitation shall be suspended and the peremptory period shall not run.
(18) The parties may attend the mediation meetings in person, or through their legal representatives or attorneys. An employee of the employer authorised by a written document may also represent the employer at the meetings and sign the final report.
(19) Unless otherwise agreed by the parties, mediation meetings shall be conducted within the territorial jurisdiction of the justice commission of the judicial court of first instance to which the office appointing the mediator is attached.
(20) A journalist governed by Law No. 5953 of 13/6/1952 on the Regulation of Relations between Employees and Employers in the Press Profession and a seafarer governed by the Maritime Labour Law No. 854 of 20/4/1967 shall be deemed employees within the scope of this article.
(21) In cases not provided for in this article, the provisions of the Law on Mediation in Civil Disputes No. 6325 of 7/6/2012 shall apply insofar as they are compatible with their nature.
(22) The procedure for applying to mediation, the appointment of the mediator and other matters relating to mediation meetings shall be determined by a regulation put into force by the Ministry of Justice.

MADDE 3 · Dava şartı olarak arabuluculuk
(1) Kanuna, bireysel veya toplu iş sözleşmesine dayanan işçi veya işveren alacağı ve tazminatı ile işe iade talebiyle açılan davalarda, arabulucuya başvurulmuş olması dava şartıdır. (Ek cümle:28/3/2023-7445/41 md.) Bu alacak ve tazminatla ilgili itirazın iptali, menfi tespit ve istirdat davaları hakkında birinci cümle hükmü uygulanır.
(2) Davacı, arabuluculuk faaliyeti sonunda anlaşmaya varılamadığına ilişkin son tutanağın aslını veya arabulucu tarafından onaylanmış bir örneğini dava dilekçesine eklemek zorundadır. Bu zorunluluğa uyulmaması hâlinde mahkemece davacıya, son tutanağın bir haftalık kesin süre içinde mahkemeye sunulması gerektiği, aksi takdirde davanın usulden reddedileceği ihtarını içeren davetiye gönderilir. İhtarın gereği yerine getirilmez ise dava dilekçesi karşı tarafa tebliğe çıkarılmaksızın davanın usulden reddine karar verilir. Arabulucuya başvurulmadan dava açıldığının anlaşılması hâlinde herhangi bir işlem yapılmaksızın davanın, dava şartı yokluğu sebebiyle usulden reddine karar verilir.
(3) İş kazası veya meslek hastalığından kaynaklanan maddi ve manevi tazminat ile bunlarla ilgili tespit, itiraz ve rücu davaları hakkında birinci fıkra hükmü uygulanmaz.
(4) Arabuluculuk Daire Başkanlığı, sicile kayıtlı arabuluculardan bu madde uyarınca arabuluculuk yapmak isteyenleri, varsa uzmanlık alanlarını da belirterek, görev yapmak istedikleri adli yargı ilk derece mahkemesi adalet komisyonlarına göre listeler ve listeleri ilgili komisyon başkanlıklarına bildirir. Komisyon başkanlıkları, bu listeleri kendi yargı çevrelerindeki arabuluculuk bürolarına, arabuluculuk bürosu kurulmayan yerlerde ise görevlendirecekleri sulh hukuk mahkemesi yazı işleri müdürlüğüne gönderir.
(5) Başvuru karşı tarafın, karşı taraf birden fazla ise bunlardan birinin yerleşim yerindeki veya işin yapıldığı yerdeki arabuluculuk bürosuna, arabuluculuk bürosu kurulmayan yerlerde ise görevlendirilen yazı işleri müdürlüğüne yapılır.
(6) Arabulucu, komisyon başkanlıklarına bildirilen listeden büro tarafından belirlenir. Ancak tarafların listede yer alan herhangi bir arabulucu üzerinde anlaşmaları hâlinde bu arabulucu görevlendirilir.
(7) Başvuran taraf, kendisine ve elinde bulunması hâlinde karşı tarafa ait her türlü iletişim bilgisini arabuluculuk bürosuna verir. Büro, tarafların resmi kayıtlarda yer alan iletişim bilgilerini araştırmaya da yetkilidir. İlgili kurum ve kuruluşlar, büro tarafından talep edilen bilgi ve belgeleri vermekle yükümlüdür.
(8) Taraflara ait iletişim bilgileri, görevlendirilen arabulucuya büro tarafından verilir. Arabulucu bu iletişim bilgilerini esas alır, ihtiyaç duyduğunda kendiliğinden araştırma da yapabilir. Elindeki bilgiler itibarıyla her türlü iletişim vasıtasını kullanarak görevlendirme konusunda tarafları bilgilendirir ve ilk toplantıya davet eder. Bilgilendirme ve davete ilişkin işlemlerini belgeye bağlar.
(9) Arabulucu, görevlendirmeyi yapan büronun yetkili olup olmadığını kendiliğinden dikkate alamaz. Karşı taraf en geç ilk toplantıda, yerleşim yeri ve işin yapıldığı yere ilişkin belgelerini sunmak suretiyle arabuluculuk bürosunun yetkisine itiraz edebilir. Bu durumda arabulucu, dosyayı derhâl ilgili sulh hukuk mahkemesine gönderilmek üzere büroya teslim eder. Mahkeme, harç alınmaksızın dosya üzerinden yapacağı inceleme sonunda yetkili büroyu kesin olarak karara bağlar ve dosyayı büroya iade eder. Mahkeme kararı büro tarafından 11/2/1959 tarihli ve 7201 sayılı Tebligat Kanunu hükümleri uyarınca taraflara tebliğ edilir. Yetki itirazının reddi durumunda aynı arabulucu yeniden görevlendirilir ve onuncu fıkrada belirtilen süreler yeni görevlendirme tarihinden başlar. Yetki itirazının kabulü durumunda ise kararın tebliğinden itibaren bir hafta içinde yetkili büroya başvurulabilir. Bu takdirde yetkisiz büroya başvurma tarihi yetkili büroya başvurma tarihi olarak kabul edilir. Yetkili büro, altıncı fıkra uyarınca arabulucu görevlendirir.
(10) Arabulucu, yapılan başvuruyu görevlendirildiği tarihten itibaren üç hafta içinde sonuçlandırır. Bu süre zorunlu hâllerde arabulucu tarafından en fazla bir hafta uzatılabilir.
(11) Arabulucu, taraflara ulaşılamaması, taraflar katılmadığı için görüşme yapılamaması yahut yapılan görüşmeler sonucunda anlaşmaya varılması veya varılamaması hâllerinde arabuluculuk faaliyetini sona erdirir ve son tutanağı düzenleyerek durumu derhâl arabuluculuk bürosuna bildirir.
(12) Taraflardan birinin geçerli bir mazeret göstermeksizin ilk toplantıya katılmaması sebebiyle arabuluculuk faaliyetinin sona ermesi durumunda toplantıya katılmayan taraf, son tutanakta belirtilir ve bu taraf davada kısmen veya tamamen haklı çıksa bile karşı tarafın ödemekle yükümlü olduğu yargılama giderlerinin yarısından sorumlu tutulur. (Değişik ikinci cümle:7/11/2024-7531/28 md.) Ayrıca bu taraf lehine Avukatlık Asgari Ücret Tarifesine göre belirlenen vekâlet ücretinin yarısına hükmedilir. Her iki tarafın da ilk toplantıya katılmaması sebebiyle sona eren arabuluculuk faaliyeti üzerine açılacak davalarda tarafların yaptıkları yargılama giderleri kendi üzerlerinde bırakılır.
(13) Tarafların arabuluculuk faaliyeti sonunda anlaşmaları hâlinde, arabuluculuk ücreti, Arabuluculuk Asgari Ücret Tarifesinin eki Arabuluculuk Ücret Tarifesinin İkinci Kısmına göre aksi kararlaştırılmadıkça taraflarca eşit şekilde karşılanır. Bu durumda ücret, Tarifenin Birinci Kısmında belirlenen iki saatlik ücret tutarından az olamaz. İşe iade talebiyle yapılan görüşmelerde tarafların anlaşmaları durumunda, arabulucuya ödenecek ücretin belirlenmesinde işçiye işe başlatılmaması hâlinde ödenecek tazminat miktarı ile çalıştırılmadığı süre için ödenecek ücret ve diğer haklarının toplamı, Tarifenin İkinci Kısmı uyarınca üzerinde anlaşılan miktar olarak kabul edilir.
(14) Arabuluculuk faaliyeti sonunda taraflara ulaşılamaması, taraflar katılmadığı için görüşme yapılamaması veya iki saatten az süren görüşmeler sonunda tarafların anlaşamamaları hâllerinde, iki saatlik ücret tutarı Tarifenin Birinci Kısmına göre Adalet Bakanlığı bütçesinden ödenir. İki saatten fazla süren görüşmeler sonunda tarafların anlaşamamaları hâlinde ise iki saati aşan kısma ilişkin ücret aksi kararlaştırılmadıkça taraflarca eşit şekilde Tarifenin Birinci Kısmına göre karşılanır. Adalet Bakanlığı bütçesinden ödenen ve taraflarca karşılanan arabuluculuk ücreti, yargılama giderlerinden sayılır.

(16) Bu madde uyarınca arabuluculuk bürosu tarafından yapılması gereken zaruri giderler; arabuluculuk faaliyeti sonunda anlaşmaya varılması hâlinde anlaşma uyarınca taraflarca ödenmek, anlaşmaya varılamaması hâlinde ise ileride haksız çıkacak taraftan tahsil olunmak üzere Adalet Bakanlığı bütçesinden karşılanır.
(17) Arabuluculuk bürosuna başvurulmasından son tutanağın düzenlendiği tarihe kadar geçen sürede zamanaşımı durur ve hak düşürücü süre işlemez.
(18) Arabuluculuk görüşmelerine taraflar bizzat, kanuni temsilcileri veya avukatları aracılığıyla katılabilirler. İşverenin yazılı belgeyle yetkilendirdiği çalışanı da görüşmelerde işvereni temsil edebilir ve son tutanağı imzalayabilir.
(19) Arabuluculuk görüşmeleri, taraflarca aksi kararlaştırılmadıkça, arabulucuyu görevlendiren büronun bağlı bulunduğu adli yargı ilk derece mahkemesi adalet komisyonunun yetki alanı içinde yürütülür.
(20) 13/6/1952 tarihli ve 5953 sayılı Basın Mesleğinde Çalışanlarla Çalıştıranlar Arasındaki Münasebetlerin Tanzimi Hakkında Kanunda düzenlenen gazeteci ile 20/4/1967 tarihli ve 854 sayılı Deniz İş Kanununda düzenlenen gemiadamı, bu madde kapsamında işçi sayılır.
(21) Bu maddede hüküm bulunmayan hâllerde niteliğine uygun düştüğü ölçüde 7/6/2012 tarihli ve 6325 sayılı Hukuk Uyuşmazlıklarında Arabuluculuk Kanunu hükümleri uygulanır.
(22) Arabuluculuğa başvuru usulü, arabulucunun görevlendirilmesi ve arabuluculuk görüşmelerine ilişkin diğer hususlar Adalet Bakanlığınca yürürlüğe konulan yönetmelikle belirlenir.
