Article 6: Territorial jurisdiction

(1) In actions to be brought before labour courts, the competent court shall be the court of the domicile of the defendant natural or legal person on the date the action is brought and the court of the place where the work or transaction is performed.

(2) Where there is more than one defendant, the court of the domicile of any one of them shall also be competent.

(3) In actions for compensation arising from an occupational accident, the court of the place where the occupational accident or the damage occurred and the court of the domicile of the injured employee shall also be competent.

(4) The provisions of other laws relating to the territorial jurisdiction of labour courts are reserved.

(5) Jurisdiction agreements contrary to the provisions of this article shall be invalid.

MADDE 6 · Yetki

(1) İş mahkemelerinde açılacak davalarda yetkili mahkeme, davalı gerçek veya tüzel kişinin davanın açıldığı tarihteki yerleşim yeri mahkemesi ile işin veya işlemin yapıldığı yer mahkemesidir.

(2) Davalı birden fazla ise bunlardan birinin yerleşim yeri mahkemesi de yetkilidir.

(3) İş kazasından doğan tazminat davalarında, iş kazasının veya zararın meydana geldiği yer ile zarar gören işçinin yerleşim yeri mahkemesi de yetkilidir.

(4) İş mahkemelerinin yetkilerine ilişkin olarak diğer kanunlarda yer alan hükümler saklıdır.

(5) Bu madde hükümlerine aykırı yetki sözleşmeleri geçersizdir.
