Article 40: Preliminary Inquiry

Part Four: Procedure in Examinations and Inquiries of the Board

The Board shall decide, ex officio or upon applications referred to it, either to open an investigation directly or to conduct a preliminary inquiry in order to determine whether it is necessary to open an investigation.

Where it is decided to conduct a preliminary inquiry, the President of the Board shall assign one or more of the experts who are professional personnel as rapporteurs.

The rapporteur assigned to conduct the preliminary inquiry shall notify the Board in writing, within 30 days, of the information obtained, all kinds of evidence and his or her opinion on the matter.

MADDE 40 · Önaraştırma

Kurul, resen veya kendisine intikal eden başvurular üzerine doğrudan soruşturma açılmasına ya da soruşturma açılmasına gerek olup olmadığının tespiti için önaraştırma yapılmasına karar verir.

Önaraştırma yapılmasına karar verildiği takdirde Kurul Başkanı, meslek personeli uzmanlardan bir ya da birkaçını raportör olarak görevlendirir.

Önaraştırma yapmakla görevlendirilen raportör 30 gün içinde elde ettiği bilgileri, her türlü delilleri ve konu hakkındaki görüşlerini Kurula yazılı olarak bildirir.
