A panel composed of (…) rapporteurs acting on behalf of the Board and determined and assigned by the Board may, in the investigation phase, exercise the powers to request information regulated in Article 14 and to conduct on-site inspections regulated in Article 15 of this Law. Within the period so determined, it may request the parties and other relevant places to send the documents it deems necessary and to provide all kinds of information. During the investigation phase of the Board, the person or persons alleged to have infringed this Law may at any time submit to the Board all kinds of information and evidence that may affect the decision.
The parties notified that an investigation has been initiated against them may, until their request to exercise the right of oral defence, request that a copy of all kinds of documents drawn up concerning them within the Authority and, if possible, of all kinds of evidence obtained, be given to them.
The Board may not base its decisions on matters of which it has not informed the parties and in respect of which it has not granted the right of defence.

MADDE 44 · Delillerin Toplanması ve Tarafların Bilgilendirilmesi
Kurul adına hareket eden ve Kurul tarafından belirlenip, görevlendirilen (…) raportörlerden oluşan bir heyet, soruşturma safhasında bu Kanunun 14 üncü maddesinde düzenlenen bilgi isteme ve 15 inci maddesinde düzenlenen yerinde inceleme yetkilerini kullanabilir. Belirlenen bu süre içinde lüzum gördükleri evrakın gönderilmesini ve her türlü bilginin verilmesini taraflardan ve ilgili diğer yerlerden isteyebilir. Kurulun soruşturma safhasında, bu Kanunu ihlal ettiği iddia edilen kişi veya kişiler, kararı etkileyebilecek her türlü bilgi ve delili her zaman Kurula sunabilirler.
Haklarında soruşturmaya başlandığı bildirilen taraflar sözlü savunma hakkını kullanma taleplerine kadar Kurum bünyesinde kendileri ile ilgili düzenlenmiş her türlü evrakın ve mümkünse elde edilmiş olan her türlü delilin bir nüshasının kendilerine verilmesini isteyebilir.
Kurul, tarafları bilgilendirmediği ve savunma hakkı vermediği konuları kararlarına dayanak yapamaz.
