Article 42: Notification to Applicants

Part Four: Procedure in Examinations and Inquiries of the Board

Where the Board finds the allegations put forward in denunciations or complaints to be serious and sufficient, the persons making the denunciation or complaint shall be notified in writing that the allegations put forward have been found serious and that an inquiry has been initiated.

Where the Board either expressly rejects the applications or is deemed to have rejected them by failing to give notification within the time limit, any person who documents that he or she has a direct or indirect interest may have recourse to judicial remedies against the rejection decision of the Board.

MADDE 42 · Başvuru Sahiplerine Bildirim

Kurulun, ihbar veya şikayet başvurularında ileri sürülen iddiaları ciddi ve yeterli bulması durumunda, ihbar veya şikayet edenlere ileri sürülen iddiaların ciddi bulunduğu ve araştırmaya başlandığı yazılı olarak bildirilir.

Kurulun, gerek başvuruları açıkca reddetmesi, gerekse süresi içinde bildirimde bulunmayarak reddetmiş sayılması durumlarında, doğrudan ya da dolaylı menfaati olduğunu belgeleyen herkes Kurulun red kararına karşı yargı yoluna başvurabilir.
