Chapter Four: Amendments to Other Legislation and Final Provisions

(1) Until 31/12/2027, for the purpose of procuring resources to be used in implementations within the scope of this Law, the Presidency may borrow domestically, on the basis of the total amount of receivables payable in instalments, from banks more than half of whose capital is owned directly or indirectly by the public sector. The total of the principal, interest and expenses arising from the borrowing may not exceed twenty-five per cent of the total amount of instalment receivables shown in the accounting records. The amount of borrowing and the repayment structure under this provision shall be determined in conformity with the maturity structure of these receivables. Amounts collected from the said receivables within this scope shall be used primarily for the principal, interest and other borrowing expenses arising from the borrowing.

GEÇİCİ MADDE 5

(1) Başkanlık, 31/12/2027 tarihine kadar bu Kanun kapsamındaki uygulamalarda kullanılmak üzere kaynak temin etmek maksadı ile taksitli toplam alacak miktarı esas alınarak sermayesinin yarısından fazlası doğrudan veya dolaylı olarak kamuya ait olan bankalardan iç borçlanma yapabilir. Anapara, faiz ve borçlanma nedeniyle oluşacak giderlerin toplamı, muhasebe kayıtlarında gösterilen taksitli toplam alacak miktarının yüzde yirmi beşini aşamaz. Bu kapsamda yapılacak borçlanma miktarı ve ödeme yapısı, bu alacakların vade yapısına uyumlu olarak belirlenir. Bu kapsamda söz konusu alacaklardan tahsil edilen tutarlar, öncelikle borçlanma sebebiyle ortaya çıkan anapara, faiz ve diğer borçlanma giderleri için kullanılır.
