(1) After being selected, the mediator shall invite the parties to the first meeting as soon as possible.
(2) The parties may freely agree on the mediation procedure, provided that it is not contrary to mandatory rules of law.
(3) If not agreed by the parties, the mediator shall conduct the mediation activity taking into account the nature of the dispute, the wishes of the parties and the procedures and principles required for the speedy resolution of the dispute.
(4) Acts which, by their nature, constitute the exercise of judicial power and may be performed only by a judge may not be performed by the mediator.
(5) Where, after an action has been filed, the parties declare that they will jointly apply to a mediator, the court shall postpone the proceedings for a period not exceeding three months. This period may be extended by up to three months upon the joint application of the parties.
(6) Amended: 12/10/2017, Law No. 7036, Art. 22 The parties may participate in mediation negotiations in person, or through their legal representatives or attorneys. Experts who may contribute to the resolution of the dispute may also be present at the negotiations.
(7) Added: 12/10/2017, Law No. 7036, Art. 22 Where it becomes apparent that the parties are unable to produce a solution, the mediator may propose a solution.
(8) Added: 12/10/2017, Law No. 7036, Art. 22 In mediation negotiations, the Administration shall be represented by a commission consisting of two members determined by the top executive and the head of the legal unit or an attorney or legal counsel to be designated by him or her. At the end of the mediation negotiations, the commission shall draw up a reasoned report and keep it for five years.
(9) Added: 12/10/2017, Law No. 7036, Art. 22 Actions for damages arising from the acts performed and decisions taken by commission members within the scope of the mediation activity may be filed only against the State. The State shall have recourse, within one year from the date of payment, against members who abused their duty by acting contrary to the requirements of their duty, for the compensation it has paid.
(10) Added: 12/10/2017, Law No. 7036, Art. 22 The procedures and principles relating to the implementation of this Article shall be regulated by a regulation put into force by the Ministry.

MADDE 15 · Arabuluculuk faaliyetinin yürütülmesi
(1) Arabulucu, seçildikten sonra tarafları en kısa sürede ilk toplantıya davet eder.
(2) Taraflar, emredici hukuk kurallarına aykırı olmamak kaydıyla arabuluculuk usulünü serbestçe kararlaştırabilirler.
(3) Taraflarca kararlaştırılmamışsa arabulucu; uyuşmazlığın niteliğini, tarafların isteklerini ve uyuşmazlığın hızlı bir şekilde çözümlenmesi için gereken usul ve esasları göz önüne alarak arabuluculuk faaliyetini yürütür.
(4) Niteliği gereği yargısal bir yetkinin kullanımı olarak sadece hâkim tarafından yapılabilecek işlemler arabulucu tarafından yapılamaz.
(5) Dava açıldıktan sonra tarafların birlikte arabulucuya başvuracaklarını beyan etmeleri hâlinde yargılama, mahkemece üç ayı geçmemek üzere ertelenir. Bu süre, tarafların birlikte başvurusu üzerine üç aya kadar uzatılabilir.
(6) (Değişik: 12/10/2017-7036/22 md.) Arabuluculuk müzakerelerine taraflar bizzat, kanuni temsilcileri veya avukatları aracılığıyla katılabilirler. Uyuşmazlığın çözümüne katkı sağlayabilecek uzman kişiler de müzakerelerde hazır bulundurulabilir.
(7) (Ek: 12/10/2017-7036/22 md.) Tarafların çözüm üretemediklerinin ortaya çıkması hâlinde arabulucu bir çözüm önerisinde bulunabilir.
(8) (Ek: 12/10/2017-7036/22 md.) Arabuluculuk müzakerelerinde idareyi, üst yönetici tarafından belirlenen iki üye ile hukuk birimi amiri veya onun belirleyeceği bir avukat ya da hukuk müşavirinden oluşan komisyon temsil eder. Komisyon, arabuluculuk müzakereleri sonunda gerekçeli bir rapor düzenler ve beş yıl boyunca saklar.
(9) (Ek: 12/10/2017-7036/22 md.) Komisyon üyelerinin arabuluculuk faaliyeti kapsamında yaptıkları işler ve aldıkları kararlar sebebiyle açılacak tazminat davaları, ancak Devlet aleyhine açılabilir. Devlet ödediği tazminattan dolayı görevinin gereklerine aykırı hareket etmek suretiyle görevini kötüye kullanan üyelere ödeme tarihinden itibaren bir yıl içinde rücu eder.
(10) (Ek: 12/10/2017-7036/22 md.) Bu maddenin uygulanmasına ilişkin usul ve esaslar Bakanlıkça yürürlüğe konulan yönetmelikle düzenlenir.
