Article 18: Agreement of the parties

Chapter Four: Mediation Activity

(1) The scope of the agreement reached at the end of the mediation activity shall be determined by the parties; where an agreement document is drawn up, it shall be signed by the parties and the mediator.

(2) If the parties reach an agreement at the end of the mediation activity, they may request that an annotation on the enforceability of this agreement document be granted. If mediation was resorted to before an action was filed, the granting of the annotation on the enforceability of the agreement may be requested from the civil court of peace of the place where the mediator performed his or her duty. If mediation is resorted to during the hearing of an action, the granting of the annotation on the enforceability of the agreement may be requested from the court hearing the action. An agreement containing this annotation shall be deemed a document having the nature of a court judgment.

(3) The granting of the annotation of enforceability is a matter of non-contentious jurisdiction and the related examination shall be conducted on the case file. However, in disputes relating to family law that are suitable for mediation, the examination shall be conducted with a hearing. The scope of this examination shall be limited to whether the content of the agreement is suitable for mediation and compulsory enforcement. A fixed fee shall be charged for the application to the court for the granting of an annotation of enforceability to the agreement document and, where the interested party appeals against the decisions given thereon to the regional court of appeal, for such appeal. If the parties wish to use the agreement document in another official transaction without having an annotation of enforceability granted, stamp duty shall also be charged at a fixed rate.

(4) Added: 12/10/2017, Law No. 7036, Art. 35 Except in cases where obtaining an annotation of enforceability is made mandatory by law, an agreement document signed jointly by the parties, their attorneys and the mediator, or, in respect of commercial disputes, by the attorneys and the mediator, shall be deemed a document having the nature of a court judgment without requiring an annotation of enforceability.

(5) Added: 12/10/2017, Law No. 7036, Art. 24 Where an agreement is reached at the end of the mediation activity, the parties may not file an action concerning the matters agreed upon.

MADDE 18 · Tarafların anlaşması

(1) Arabuluculuk faaliyeti sonunda varılan anlaşmanın kapsamı taraflarca belirlenir; anlaşma belgesi düzenlenmesi hâlinde bu belge taraflar ve arabulucu tarafından imzalanır.

(2) Taraflar arabuluculuk faaliyeti sonunda bir anlaşmaya varırlarsa, bu anlaşma belgesinin icra edilebilirliğine ilişkin şerh verilmesini talep edebilirler. Dava açılmadan önce arabuluculuğa başvurulmuşsa, anlaşmanın icra edilebilirliğine ilişkin şerh verilmesi, arabulucunun görev yaptığı yer sulh hukuk mahkemesinden talep edilebilir. Davanın görülmesi sırasında arabuluculuğa başvurulması durumunda ise anlaşmanın icra edilebilirliğine ilişkin şerh verilmesi, davanın görüldüğü mahkemeden talep edilebilir. Bu şerhi içeren anlaşma, ilam niteliğinde belge sayılır.

(3) İcra edilebilirlik şerhinin verilmesi, çekişmesiz yargı işidir ve buna ilişkin inceleme dosya üzerinden yapılır. Ancak arabuluculuğa elverişli olan aile hukukuna ilişkin uyuşmazlıklarda inceleme duruşmalı olarak yapılır. Bu incelemenin kapsamı anlaşmanın içeriğinin arabuluculuğa ve cebri icraya elverişli olup olmadığı hususlarıyla sınırlıdır. Anlaşma belgesine icra edilebilirlik şerhi verilmesi için mahkemeye yapılacak olan başvuru ile bunun üzerine verilecek kararlara karşı ilgili tarafından istinaf yoluna gidilmesi hâlinde, maktu harç alınır. Taraflar anlaşma belgesini icra edilebilirlik şerhi verdirmeden başka bir resmî işlemde kullanmak isterlerse, damga vergisi de maktu olarak alınır.

(4) (Ek: 12/10/2017-7036/35 md.) Kanunlarda icra edilebilirlik şerhi alınmasının zorunlu kılındığı haller hariç, taraflar ve avukatları ile arabulucunun, ticari uyuşmazlıklar bakımından ise avukatlar ile arabulucunun birlikte imzaladıkları anlaşma belgesi, icra edilebilirlik şerhi aranmaksızın ilam niteliğinde belge sayılır.

(5) (Ek: 12/10/2017-7036/24 md.) Arabuluculuk faaliyeti sonunda anlaşmaya varılması hâlinde, üzerinde anlaşılan hususlar hakkında taraflarca dava açılamaz.
