A passport or travel document shall not be issued to persons whose departure abroad has been prohibited by courts, (…) and to persons determined by the Ministry of Interior to be founders or managers of, or to work at, any kind of educational, teaching and health institutions, foundations, associations or companies abroad whose membership of, affiliation with or connection to terrorist organisations has been established (…). However, persons other than those whose travel to foreign countries has been prohibited by courts may, in cases of necessity, be issued a passport or a travel document in lieu of a passport with the approval of the President of the Republic.
The full identities of persons in this situation (name, surname, place and date of birth, mother's and father's names, and place of civil registration) and the reason for the restriction shall be notified by the relevant departments to the local police authorities.
The relevant police authorities shall, immediately upon receiving this information, notify it in writing, through the provincial police directorate to which they are attached and by the fastest means of communication, to the police directorates where border gates are located, to the provincial police directorate of the place where the person is entered in the civil registry, and to the General Directorate of Security.
The departure abroad of such persons shall be prevented and no passport or document shall be issued to them; if one has been issued, it shall be withdrawn.
The expired passports of persons who have been prohibited, by the authorities referred to in paragraph 1, from being issued a passport or from leaving the country, and of persons whose remaining abroad has been determined to be objectionable in terms of general security, shall not be renewed; they shall be issued a travel document in order to return to Türkiye.
A passport or document may be refused, taking into account the reasons for their expulsion from those countries, to persons who have lost their passports or documents in lieu of passports and are unable to base this on a justified reason, and to persons who have been deported from the countries in which they were present.

Yurt dışına çıkmaları; mahkemelerce yasaklananlara, (…) ve terör örgütlerine aidiyeti, iltisakı veya irtibatı belirlenen yurtdışındaki her türlü eğitim, öğretim ve sağlık kuruluşları ile vakıf, dernek veya şirketlerin kurucu ve yöneticisi olduğu veya bu yerlerde çalıştığı İçişleri Bakanlığınca tespit edilenlere (…) pasaport veya seyahat vesikası verilmez. Ancak, yabancı memleketlere gitmeleri mahkemelerce yasaklananlar dışında kalanlara, zaruri hallerde Cumhurbaşkanının onayı ile pasaport veya pasaport yerine geçen seyahat vesikası verilebilir.
Bu durumda olanların açık kimlikleri (adı, soyadı, doğum yeri ve tarihi, ana ve baba adı ile nüfusa kayıtlı olduğu yer) ve tahdit sebebi, ilgili daireler tarafından mahallin polis makamlarına bildirilir.
İlgili polis makamları da bu bilgileri alır almaz bağlı bulunduğu il emniyet müdürlüğü kanalıyla en seri haberleşme aracıyla yazılı olarak hudut kapısı bulunan emniyet müdürlüklerine, şahsın nüfusa kayıtlı olduğu il emniyet müdürlüğüne ve Emniyet Genel Müdürlüğüne bildirir.
Bunların yurt dışına çıkışları engellenir ve kendilerine pasaport veya vesika verilmez, verilmişse geri alınır.
Birinci fıkrada yazılı makamlar tarafından pasaport verilmesi veya yurt dışına çıkması yasaklananlarla, yurt dışında kalmalarında genel güvenlik bakımından mahzur bulunduğu tespit edilenlerin süreleri dolan pasaportları yenilenmez, kendilerine Türkiye'ye dönmeleri için seyahat vesikası verilir.
Pasaport veya pasaport yerine geçen vesikaları kaybedenlerden, bunu haklı bir sebebe dayandıramayanlarla bulundukları ülkelerden sınır dışı edilmiş olanlara, bu ülkelerden çıkarılış sebepleri gözönünde tutularak pasaport veya vesika verilmeyebilir.
