Article 38: Restriction of competition

Part One: Private International Law › Chapter Two: Conflict-of-Laws Rules

(1) Claims arising from restriction of competition are governed by the law of the country whose market is directly affected by the restriction.

(2) Where foreign law applies to a restriction of competition in Türkiye, compensation may not be awarded in excess of the amount that would be awarded if Turkish law applied.

MADDE 38 · Rekabetin engellenmesi

(1) Rekabetin engellenmesinden doğan talepler, bu engellemeden doğrudan etkilenen piyasanın bulunduğu ülkenin hukukuna tâbidir.

(2) Türkiye’de rekabetin engellenmesine yabancı hukuk uygulanan hâllerde, Türk hukuku uygulansaydı verilecek tazminattan daha fazla tazminata hükmedilemez.
