Article 39: Unjust enrichment

Part One: Private International Law › Chapter Two: Conflict-of-Laws Rules

(1) Claims arising from unjust enrichment are governed by the law applicable to the existing or allegedly existing legal relationship that gave rise to the enrichment. In other cases, unjust enrichment is governed by the law of the country where the enrichment occurred.

(2) After the unjust enrichment has occurred, the parties may expressly choose the applicable law.

MADDE 39 · Sebepsiz zenginleşme

(1) Sebepsiz zenginleşmeden doğan talepler, zenginleşmeye sebep olan mevcut veya mevcut olduğu iddia edilen hukukî ilişkiye uygulanan hukuka tâbidir. Diğer hâllerde sebepsiz zenginleşmeye, zenginleşmenin gerçekleştiği ülke hukuku uygulanır.

(2) Taraflar, sebepsiz zenginleşmenin meydana gelmesinden sonra, uygulanacak hukuku açık olarak seçebilirler.
